2004 Consolidated Tracker ONLY (140/EAD/AP/FP/485)

Hi!,

Could some suggest regarding my case
Lud's didn't changed till now . It is almost going to be one year since i applied for 140/485
Mine is 3 year degree. After reading this portals, i think i may get ref. regarding education.
could any body suggestion about this

I hope all the march filers should get their approvals soon.
Do you know what happens to our advance parole if 485 is approved? Is it invalid immediately?
I am also eagerly waiting for my 485 approval anytime soon. But i have this worry, i need to travel outside the country with AP , what will happen to the validity of AP if 485 it gets approved on that day of my approval or while i am outside the country?
Please put in thoughts and insight.
 
We in my case I do not have any contact from my lawyer and never used to get any information on my case and I wanted to study my case and look what is in labor since mine is labor substitute.
Using FOIA, which freedom of information act, you can get all the documents submitted by your lawyer and you can know more about your case. In most cases it is free upto some limit of documents and time to get those documents.

140 --- EB2 etc.

Hi guys!
I am primarily a reader of this forum and have often gained invaluable info from all of you.
My 140 was recently filed in VSC. RD: 01/03/05, ND: 01/05/05
On the 140 receipt notice it states that the section it was filed under was "Advanced Degree + Exceptional Ability".
I have a Bachelor's Degree + 8 years experience in the US (Canadian Citizen on TN prior to H1B). 7 years at time of labor filing.
The paralegal at my lawyer's offices is telling me that it was filed under that section because the labor was filed under BS + 5 years experience so therefore its EB2
I have noticed processing times for this section are 1 year behind. Whereas those for "skilled worker/professional" are only 2.5 months behind or so.

Does the 140 have to be filed in this category? By the way I filed only 140 hoping to do CP thinking the wait won't be that long..

Any advise?? Are 140 approvals in EB2 taking 12 months as per proc dates?
Also does the retrogression apply to me? I am a Canadian citizen born in India.
Appreciate your response.

You should be able to file under EB3 category. And in your case it might be beneficial to do so, as you are not impacted by the PD retrogression (I believe you were born in Canada).
 
140 filing under EB3 or EB2

Do I still get impacted?
I am told by the paralegal that I cannot file under EB3. That I have to stick to EB2. Is this correct?

If you were born in India then you will be impacted by the retrogression irrespective of your citizenship. In that case it is better for you to file under the EB2 category, as visa numbers are current for EB2. The visa numbers in the EB3 category have retrogressed to PD of 01/01/2002 for applicants born in India, mainland China or Philippines.

OK thanks. The only thing I fail to understand is then how can 140 approval dates for "skilled worker/professional" be mid Oct 2004 and that of 'advanced degree/exceptional ability" be Dec 2003.
Does this mean that going forward the dates for 140 approval for skilled worker aka EB3 will not progress as fast?
 
These dates are not accurate. Look at the tracker and you will see many people who filed their 140 in EB2 category recently have been approved. It's true that I-140s for EB3 category were being processed even faster last year but I haven't seen any EB3 140 approvals in January. Also, you end goal is to get 485 faster rather than getting 140 approved and waiting for 485 to get approved.

I am not sure as to why you feel that you are going to get an RFE.... Mine is also a 3 year degree with couple of diplomas. I got my 140 approved. It all depends on your Labor as to how the education information has been mentioned. I think you should be okay

MA Labor: sorry to continue bombarding you ;-)
I am looking to do Consular Processing rather than 485 based on lawyer's recommendation.
So what do you think...should I just let it continue in EB2?

I am a native born Canaidan (born in Alberta). The five years, is how long until I can become a US citizen. :) Sorry for the confusion.
