Can anyone give me any inputs of what might be going on in my case...As the LUD keeps on changing and I get no response... :confused: I did an address change and does this change the LUD as well ?? thanks in advance..

I rcvd mail regarding my 140 approval.

EB2...That's what my 140 says!!!
Substitute labor

I hope this is not error from USCIS as I don't have actual approval in hand yet.

Is this new trend at VSC for EB2??

FP ND 12/07/2004.
They have scheduled me on 1/3/2005.
Things seems to be moving finally.
Please update my info.

RFE for AP..

Hi,
Today i Received RFE Email from USCIS regarding my "Advance Parole" Application(I-131)
Status=>On December 8, 2004, we mailed a notice requesting additional evidence or information in this case.
The notice explains in detail what additional material is needed.
Could some one please update Tracker
 
FP done - 11/23/04; no LUD or email so far

Please update my profile on the tracking spreadsheet.
I completed my FP in Boston - 11/23

I have not seen a change in my LUD for the 140/485, nor have I eeceived any email confirming that the FP was received. Is this normal? Any cause for worry?

Please let me know if there is a way to follow-up with USCIS directly on this or maybe through my lawyer.

I am in the same boat as you. I already filed the MTR. Just wanted to ask if I am going to recieve new receipt numbers or will have the same old number and also will LUD changed once they receive it ?

They are doing so as per Yates Memo. You can read the memo for exact words, but It states that if all the required documents are present, then the officer can deny the case without issuing the RFE. If the docs are missing, then only a RFE will be issued. Bad luck, my lawyer did a very good job of attaching all the docs, just he didn't put any effort to prepare good ones.

Depends on the officer. I think if you have a foreign degree, althoug 4 year Engineering, you should attach a education evaluation. In my opinion, if my 140 had met the criteria for 'Ability to Pay', then the officer might have issued a RFE for education eval, but my case was being denied on 'Ability to Pay', so s/he added this one also to the denial.

There is a second chance though, filing MTR and appeal (290B). But I think to overcome RFE is easier than denial and you get only 30 days to file it.

You will receive new receipt number for 290B. I would suggest you to add your details in this thread and most of MTR related questions are also answered there:

Jan'05 visa bulletin

per Jan'05 visa bulletin, EB3 category retrogressed back to Jan'02 which means the visa numbers will only be available after the date advances. Which makes me believe that USCIS's focus would now shift to EB2/1 category which still remains current and we should hopefully see some activity in EB2/1 category. The good thing that they did in favor of EB3 guys is that they cleared their I-140, making portability rule available to them. Hope for the best.......
