can someone add me in tracker. 140 and 485 was filled together yesterday for me. LC cleared from VA.

EB3 I-140/I-485/AP/EAD filed in Jan 2004 with substituted LC.
Receipt Date 1-Feb-2004

USCIS site reported 1-Mar-2004 as the date the application was received.

24-MAR-2004 - I-140 RFE
30-MAR-2004 - RFE documents sent to USCIS
25-MAY-2004 - RFE received by USCIS
16-JUN-2004 - I-140 Approved

No EAD/AP

AP estimated date jumped from 30-60 days to 15-180 days on 19-MAY-2004.

Congratulations! That was super-quick. The RFE did you good, I guess :) Worth posting in the unbelievably fast approvals thread.
 
An Oasis in the USCIS Desert

In the sea of RFEs , I see tiny land today. I have RFEs on my AP/EAD/H1. Today they acted on my EAD RFE and guess what ? they approved it.


Does it mean even if one has serious issue with H1( when pay stubs are unavailabe/ maintaining status after lay offs etc, H1 REF is certain), he/she can join new company and file 140/485 on substitute labour and get 140 approved???? Interesting. right?

If we have unexpired/uncancelled I94 then I think we are fine.

Missed 1 year...can I proceed with I-140 and 485

Hi,
I was wondering if anyone had a comment on my case... I filed for labor in 2002 and my labor has almost cleared. However, since August 2003, I have been on F1(I changed H1 to F1). Now I want to go back to H1 with the company that had filed my labor and proceed with I-140 and 485. Will I have problems since my W-2 for 2003 and 2004 will obviously not show a lot of earning since I was going to graduate school at that time?

W2 will not be a problem. But get back on H1b visa properly before proceeding with GC as F1 is not dual intent visa.

Well I also joined the group having some ray of light.

My wife got EAD, just Email-notification on 6/18/04
No EAD for me yet.
Rest status remains the Same.

LC_Virginia.. You are doing awesome job, Please update this, if it helps.(although it is half EAD)
