Sarwar,

Most important is that you applied for your family in time. It would have been too risky if you would have got concurrent approval before filing for your family! (not that there is no way out - but that it would be complicated and time taking).

Do not worry about LUDs at this point - perhaps they are running background check for your wife.

140 is perhaps most important part in the whole journey - once you are done with that - rest is matter of time for normal cases! So relax and have fun with your family!

When I had called VSC way back in May, the rep had said that everything was clear and the case would be taken up shortly. After that I got RFE for both myself and my spouse. Hopefully that meant that everything was clear (including name/security check)... I hope.

Primary Aproved?

Looks like BCIS is approving only primary applicant and keeping VISA numbers for others.. Hey may be it is good for people like us.
I hope that Secondary's will get their approval soon.

Any one know how does this might effect my case.
I applied for GC in DEc 2001 and entered into my last stage of approval now..
during my long wait, i applied for canadian PR and got approval and went there, landed and took the card and came back. There is a candian immigarion stamp in my passport. I never really stayed in canada other than land and comeback.
Now, during the last week I got an RFE as part of my 485 application here asking me to provide Legible copies of all pages of my passport, I think thats what they need before the appoval.
what you Gurus think, the effect of canadian immigartion stamp in my passport will have on my 485 approval ?
Any insights are really appreciated.

Does retrogression affect the dependents of EB1 and EB2? Anyone knows how the USCIS uses the visa numbers for dependents?

I also have same LUDS like you including FP Rececived. I haven't got any approvals yet.I haven't seen any approvals for Dec 2004 filers recently. May be they haven't started looking them . Hope we all get soon.

I called VSC customer service to enquire about my I-485 case status
The cust. service lady mentioned that Name Check is pending and would require more time. She would not say when Name Check was initiated. She also said that nothing else is wrong with my case.

My first & last name are both very common Indian names, maybe that triggered name check hell.

I called VSC cust. service at 1-800-375-5283 then
options: 1, 2, 6, 1, EAC#, 1, 3, 4, Cust Suppt Lady

What should I do now?
I have sent email to FBI in April and have not received a reply.

Thanks for any help.

hi Jd_mass,

How were u able to get VSC ppl tell about security check..Reason is I tried calling them and they said I cannot ask about status as my ND is still way way far from VSC I 485 processing times posted.My RD/ND is November.

It seems that ur ND is still not reached as far as official VSC processing times are concerned..

jd_mass: just curious - didn't the VSC rep. ask why you are calling when they are still dealing with cases w/ND 8/19/04?

Need H-1B Visa

Friends,

I have my I-140 approved, I have EAD and AP until Feb 2006. Please advice do I need to file for H-1 Visa, does filing H-1 visa adds any value during traveling to India or Job change or otherwise. My I-485 seems to get stuck in name check, so little home for GC for now.

Please advice for H-1 visa requirements

Well, I persisted

You are right, I had expected her to say that the processing dates have yet to reach my ND.

She initially said that the status of the case is same as online status. I then mentioned to her that it appears that many people who have similar ND to my case have already been approved and so I am worried about my case.

She then asked for my EAC# and looked up my case. She said that there were no problems just that name check is pending and I have to wait for some more time. She did not appear to think that being stuck in name check is a problem!!

As per processing date my RD is alredy passed, but not yet 30 days passed. I did not do any enquiry on my I-485.
Should I call now to find status or wait until 30 days to pass? any advice??

I think you should call VSC as suggested by jd_mass. Won't hurt for sure...they seem to be processing only EB1 these days!

2001_Labor,

I happen to be in a simiar boat. Got Candian PR and came back, still waiting for 485.

I don't think we will have any problem. During our GC 'sadhana' here, at no time did they ask or we say anything about residence status in a third country. Then how can we be at fault? Canada may have a good reason to cancel your PR, but not other way around. (If Canada were a person, she would certainly do it, but being a country she still has to follow her rules.)
