what is this 3 month thing? Does it apply to only EB-3's. My GC is in the mail, but I received my wife's EAD extension card today. They approved my GC and my wife's EAD card. I am very confused. Any ideas? Please can someone shed some light?

Is that normal?

How long normally does it take between spouses?

Does 3 month apply to us ? (I am in EB2 category)

Wow what a day ! Congratulations for recent approvals.
My wife's 2nd EAD got approved yesterday. My case also may be stuck up in name check!!!. Waiting for the official response to inquiry.

Are there limitations to leave the employer after GC approval?

This is not at all a problem. She can explain it to officer at POE that she assumed your last name as her last name after marriage and it is perfectly valid (both India and USA). There will be no problem whatsoever.

On top of that she can state that this name was put in her 485 application and USCIS approved it.(no one will go till this extent).

In case if officer at POE is not satisfied, they may get her FP at POE and match it against her FP on GC. She can also offer same too.

checked with lawyer who said it is ok if i send to my wife the card by mail or by other means, and then she can travel on GC. i hope this does not create any problems,. as by now i am so tired of them...

Does anyone know, how to check the I-140 status without the receipt number? I have I-485 receipt number and A#.
As per USCIS, it is not possible without receipt number.

I-140/I-485 RD - 12/13/2005, ND - 12/15/2005
EAD RD - 01/04/2005, ND - 01/06/2005, AD - 01/26/2005
AP RD - 01/04/2005, ND - 01/06/2005, AD - 03/17/2005
FP ND - 03/25/2005, FP Date - 04/09/2005
I-485 - FD results received on 04/18/2005, LUD 04/20/2005
 
Hoping for lots of EB1/2 approvals this week and beyond

I understand the waiting pain for EB3 filers, but this week is expeted to be big for EB1/2. Reason may be not to many H1s to process and EB3 being not processed for some time.
Any thoughts guys?

yes, the 3 month wait is only applicable to folks on EB-3 category from India, China, Phillipines and Mexico. you are good..based on your dates and EB-2 category, I would be surprised if you do not receive your card in the next couple of months!

I am honestly not sure what you mean by "How long normally does it take between spouses?" Are you in-between spouses? just kidding...adding some levity to the forum! Seriously, I am not what are you asking?

Minor update, the 3 month wait is applicable to all EB-3 category, except schedule A.

Looks like USCIS went on a frenzy July 1st especially on EB1 and EB2 cases. Guess part of it had to do with the EB3 dates? Here's to a sustained swiftness in approvals in the coming months. And of course for the EB3 dates to be back on track.

About my case, 140 has been approved in Jan-05 but 485 is pending since last March 2004. I have followed Name check inquiry thru email and fax as suggested in the forum. 485 Message indiactes, "Your fingerprint results are recieved on Nov 2004 and processing has been resumed...." since 6 days after fp done in nov-04.
Q1- Does this mean FP check is done ? Do i have to ask for FP status?
Q2-How much time it takes for fbi to respond? Am I going to get separate email for myself and my spouse ?
Q3-485 processing days are beyond my case. Any suggestion ?

FP's are received properly and reviewed. Not Name check though!

It looks like FBI is responding for e-mail's sent in Jan 2nd week. They are very slow and may take 3-4 months for FBI name check status information. If you and your spouse sent one e-mail, you should get the response in one e-mail otherwise two separate e-mails.

You can defintiely raise a offical enquiry and depending on the information provided, can contact local senator/congressman to expedite(!) check previous posts by Jharkandi about this topic.
