2001 Law to aid illegal alien workers seeking residency in US

Hello,

This is in regards to the 'Year 2001 Law to aid illegal alien workers seeking residency in US passed under Bill Clinton presidency'. I know a guy (an experienced Chef in an Indian restaurant) who applied for residency in 2001 as he came under this law. He got I-140 approved and then got work permit for one year. He got SSN too after that. And he recently applied for work permit extension. But few months ago, he got a query from INS to submit previous years filed tax returns proof, he contacted IRS but they tend to be lazy and took lot of time to send it, but unfortunately in the mean time he got a 'Notice of Removal Proceedings' from INS and now he has to appear in court for that. He has the tax returns proof now, so what can be the recommended approach in court so as to get it approved ?
