140 tracker for EB2 , premium processsing

PP I-140 approved @ NSC

LC: RIR July 2003; EB2
AD: Late December 2006

I-140: RD: 2/21/2007; LUD: 2/22/2007; 2/26/2007; 2/27/2007; AD: 2/27/2007 (per email)

I have not got my I-485 case number yet.

I-140 Approved in a week Receipt date 3/2/07 and Approval date 3/07/07

5 days approval for Premium processing.

See you all in I-485 forum.

LUDs on 3/26 & 3/27 (I-140 PP)

my I-140 was approved on 3/30/07 and few more LUD on 3/30 & 3/31, Received Approval email on 3/31.

For my I-140 NSC received RFE response on 3/26/07 and on 3/26/07 there was a Case status change on USCIS web site: "Current Status: Response to request for evidence received, and case processing has resumed."

There were two LUDs in a row:

1) on 3/26/07 (This is for RFE response received around 3:00pm)
2) on 3/27/07 (Around 10:00AM, is this the indication that they are close to make a decision)

Based on your experience and considering that it is a Premium Processing case Do you think that two LUDs in a row is indication that they are about to make a decision in a day or two?

Thanks

Any problems in converting to PP

My I-140 and I-485 (EB2) were filed concurantly via regular processing. I inquired from my lawyer to upgrade to PP. He suggested not to do it on the basis of high rate of rejection of converted PPs by NSC. He also mentioned that recently immigration lawyers assoc. has advised lawyers not to convert to PPs at NSC?
Anyone heard about this? Experiences posted here reflect differently. Any immigration lawyer care to comment?
Thanks

If you have a strong case then no problem in upgrading to PP. Its always better to provide case details.
e.g: If Labor requirement is 4 years BS degree and you meet requirement by having a 4 yrs Bachelors degree, or if requirement is MS and you meet requirement by Masters Degree and you have a 4 years Degree before MS plus you have required experience and being paid correct wage as mentioned on LC.

RE:Any problems in converting to PP

One of my colleagues' I-140 was rejected when he initially filed under regular and later converted to PP. I strongly advise not go for PP, especially in your case under EB2 unless you are confident that all yours/Company papers/documents are good.

Good luck

SRK

Thanks KGP and SRK for your comments. I have four years B.E (engineering) and an MBA (both non US degrees). EB2 required a masters. My education was equated to US masters and my LC (Perm) was approved on this basis. I have 12 years experience of my industry.
KGP when you say paying as mentioned on LC, you mean LC for my H1-B that I am currently on?
SRK you suggested not to go for PP. Is scruitny different for PP and regular processing?

I don't mean LC for H1B. I mean LC (Labor certification) for GC for which you filled I-140. And Yes, scruitny is different for PP and regular processing and PP is handled by different staff (Specially trained for PP).

Hello all:
When I-140 is filed in premium processing, do we get receipt notice in regular mail or email? Can some one confirm?

I filed second I-140 in premium processing with my original LC today. My first I-140 is still pending and I can not upgrade it since we applied first one with copy of LC.

Thanks!

My second I140 filed with original LC (own LC) in premium processing. This went to Texas Service center, but all my previous filings are at Nebraska. Hope I get an answer in few days.

Thanks!

HI ALL:
I got my second I140 approval today with premium processing at TSC though the first one is still pending at NSC. My attorney is going to port this I140 in place of my first I140. Both are filed from same company. But I got a reply recently from USCIS for my inquiry with OMB (which forwarded it to USCIS) that my background check is still pending.

Best wishes..

Was your 1st 140 filed in Regular process? Can you file your 140 in premium process while your 1st 140 is still pending?
Please answer my questions.
Thanks

Friends,

We had sent my RFE to I-140 on February 6, 2007 - no response yet. RFE was on my educational qualifications and company's ability to pay. The case status online says I should receive a response in 60 days but its been more than that.

Anyone else in similar situation.

WORRIED :(

PP I-140 Approval

Hi, some of you may know me from the PBEC tracker thread.

My I-140 was sent to NSC on 4/23 and I was notified yesterday (4/30) by the company's immigration specialist that my application has been approved. I don't know the exact dates since I do not have the receipt or the approval notice in hand; but once I get a copy I'll post the details.

I-140 might decline:

I got my labor done (Eb-2 RIR) and I applied for I-140.
It was mentioned in the labor application that the position needs Masters plus 3 years experience before joining my current employer.

I have 3 years "full time" experience after my BE and Masters with no experience
My question is it ok to claim experience after my BE? I am under impartation that MS+3 mean you should have 3 years of experience after MS.
