Hi ,
I got an RFE for my I140.USCIS asked to send the last two years of w2 and company finincial statements.My Question's are,
1.My W2 for 2002 shows for 36K,2.My W2 for 2006 shows for 38K
For the Company finincial statements for the two years , they didn't show any profit. Attroney is planning to respond in few wks. I feel that they might deny this case. Any body have this experience, pl share.

Can I have more details when did you get RFE and when INS received your response and when it was approved ???

mine is I-140/485----Sept 29 2003--RD
EAD/AP--approved on jan 15 th 2004
RFE for I-140 on Sept 21 2004(W2 forms of mine and Financial updated documents of the company)

Response received on 23rd nov 2004 by INS

What is your salary in LCA??(proferred wage)

Hi ,
for both years the salary for me is 60K / year and i guess the preferred wage for year 2002 and 2003 is 45K.

You mean to say the salary mentioned in LCA is 60k per annum and you w2 for 2002 is 36k and 2003 is 38k

Am I right????

It is confusion from your posts. If you are saying both years salary for you was 60K / year. What are you worrying for? Why the W2 figures are different from your previous post?

Company make loss or profit is not an direct issue. My company had only 5 people (cut from 100 in one year) by the time when I received RFE and had made loss about 2 millions each year ever since it was established. We replied RFE and case was approved.

Unitednations I have a question(silly) for you:

Proferred wage--is the wage mentioned in LCA???
Actual wage ---is the wage we get per annum(w2 for 2001/2002/2003....)

Please clarify

That's correct.

The proffered wage is what your company says they are going to pay you in order to get LCA certified.

I would like to add something,
In my opinion, LC and LCA are two different things:

> LCA (Labor Condition Application) is for H1 purpose.
> LC (Labor certification) is for GC purpose, proferred wage and ability to pay are related to LC.

I think the foregoing discussion is about I-140 and you are discussing about proferred wage on Labor certification, just wanted to clarify.
