12/99 I-140 redo, still waiting, anybody same boat?

Nothing happens ever since, both I-140 and I-485
messages not change. Called IIO last week,
say it is in an officer\'s hand and will take another
3-4 weeks.

Anybody with the same boat? How much longer
it is going to be? Did anybody talk to IIO again
to see if stop processing I-140 now in VCS will
affect the I-140 Redo processing?

What did your company send back to INS on 12/11/99, is the Notice Reciept?

if yes, should we send this to INS?

My lawyer said there is no need to send this back to INS.

Yes, it is the I-140 Redo application receipt.

It is the receipt that VCS send to the company after they receive
the I-140 Redo response for the RFE. And then the company
send this receipt back to VCS.

The reason for that is I-140 and I-485 are two different department.
They operate seperately. After I-485 department get your response
with the I-140 Receipt, they start to look at your final I-485 application
by retrieving the result from I-140 department. Otherwise how to
trigger I-485 department to process your application after the RFE?

I thought that I140 filing is a response for the RFE, and my lawyer already sent the RFE papers with i140 application.

I’m really confused now!

I think what your lawyer did is also correct.
After all, it is to let the IIO knows that you
have filed a I-140 redo in response for the
RFE.

Actually i called the INS today to check this out, and they said i don\'t need to send the receipt notice to them.

Anyhow i got to know this trick; some people may know it.
You can call the 1-800-375-5283, and if they get confused and cannot answer your question, then guess what, they will transfer you to IIO!!!

The I-140 Redo is finally got approved on Jan 18. The AVM message
does not change. My lawyer called VSC on Jan 19 and got the info
that the I-140 was approved the day before. Now my I-485 application
is in an officer\'s hand. Seems like it is not completely forgotten.

Hopefully my case is not as some of the examples that you gave as
the "forgotten" or "missed" case, which wait a long long time.

Could you post if you have received your I-485 approval yet? I just got the same I-140 redo approved Jan. 16, 2001 and message changed on Jan.18, 2001 for I140 approval but not for I485RFE.

    Even though my I-140 (redo) was approved on Dec 21, 2000, my I-485 message still says "On Sep 28th, we sent a notice requesting additional evidence......"
    What about your I-1485 message????

Same, it says on Nov. 13, We have sent you an RFE ...

And the I-140 Redo AVM message is still as
"On Dec. 4, We receive your applications for I-140 ..."

Maybe we are in the same hand of an evil IIO?

Govinda, what is your guess about why it takes so long
for you or us to get the I-485 approved even after I-140 Redo
is approved, Looks like there is no obstucle after this anymore.
Am I right? Or there is some other reasons.

For the I-140 the AVM says, "Approved on Jan. 16, 2001".
For the I-485 the AVM says, "On Oct. 18, 2000 we mailed...."

My attorney (who apparently represents AILA at VSC), spoke to VSC on Monday (weekly AILA meeting with VSC), and they were informed that due to re-shuffling of resources after the budget approval on Dec. 26, 2000 has caused some delay in processing. In any case as per the RFE notice it indicates that it would take 14 days to process after receiving the document. This is 14 days(working days) from when the approval of I-140 was done + time taken for the documents to walk to the other department (1~3 days !!!???).

Well, I think I can see some similarities in our cases, including Samyukta\'s. In all these cases, the I-140 has been approved, but the same information has not been relayed to the I-485 application, or the person working on the same. And my experience has been that every time I call up an IIO (I have called up thrice so far, after my I-140 was approved on Dec 21, 2000), I am told that they are still waiting for a response to the RFE that they sent out. Which pretty much sums up the fact that the communication channel between I-140 approval & I-485 broke down somewhere. Again, I think this is exactly what happened/is happening in Samyukta\'s case too. I am not able to think of any way out of this other than calling the IIOs in Vermont, repeatedly and explaing the situation, and hope that someone will be sensible & good enough to realize the problem and act on it. Do you guys have any other suggestion????

Probably this might help in your analysis. My I-140 redo notice date is early Jan and On Jan 17th after 2 weeks my I-1485 message changed to \'Your response was recd on Jan 17th blah blah..\'. The I-140 still says we recd your app on Jan XX 2001 and it will take 150-240 days\'. I presume my I-140 is not yet approved but the I-485 dept knows that RFE was responded. Any Idea when I-140 redo might be approved.

My case is different. I called them on Jan 8th, the IIO told me that
they did receive the RFE reply on Dec. 13th, 2000. Somehow, the AVM
message is not changed. Even after my lawyer got the info say that
my I-140 Redo is approved on Jan. 18th, the AVM message for both
I-140 and I-485 is not change as of today.

Hope miracle will happen some time.

Surprise news.... and miracles do happen....

My lawyer received the I-485 approval notice on Wednesday, Jan. 24, 2001 for the I-140 redo (approved on Jan.16) RFE. The AVM still says "On Oct. 18, 2000 we mailed ...."

Now the funny part is I am out of the country on business and will have to use a copy of the notice along with my AP to get back in. Keep you posted.

My I140 redo just got approved yest. 1/25/2001, i hope my I485 will get approve soon.
