1099 - H1b

Dear Mr. Khanna,

I am working as a consultant with a construction company on my OPT(Expires Feb'2005).

I am not really sure if I am eligible to apply for H1B as a consultant using Form 1099 instead of W2 form.

My employer is willing to hire me as a full time employee in the next few months.

Do I have to work to apply for H1b or is it enough if I have an offer letter which, states my employment starts from a future date Ex: Sept 2004?

Can I apply for the H1B visa with that kind of offer letter right now just to be on safe side with the H1b quota issues.

I really appreciate your time and input.

H-1 can be obtained only for employment (W2, NOT 1099).

Thanks so much for the information. Could you please advice me with this issue also:

Do I have to work right now to be eligible for a H1B Visa or is it enough if I have an offer letter that indicates the employement starts from a future date(Ex: Oct'2004) because I'll be on my OPT till Feb'2005.
