Hi dear i went to the U.S as a visitor than i got married and i overstayed for 7 years without taking any action for the reunion and i went to egypt than i try to renew my visa to go back to the U.S i got ban for 10 years i been 3 years now got the ban but my question is if my wife she are citizenships can she apply for form i-130 while i still have 7 years of the ban ?

She can file I-130, but you will not get the immigrant visa until the ban is over or is waived. Why didn't get get a green card while you were in the US? Why did you leave the US?

Did you go back to the country you left to gain asylum from?

So you returned to the country you originally sought protection from, or what was the basis of your asylum?

Too bad you never applied for a GC following the approval of your asylum petition. In the interim, you should have applied for a refuge travel document since you had no GC. This would have allowed you to return to the US without a GC, and without needing to apply for a new visa at the embassy like you did.

I been 3 years now since i left the U S i still can apply for refugee travel documents?

That kiboshes your asylum claim afaik.

You can maybe look into an I601 waiver for a spousal green card application. I don’t know much about it other than that it’s an option. It will take time but if successful probably not as long as waiting another 7 years.

No.

I have been granted asylum or refugee status in the United States, and I need to travel abroad. Can I file a Form I-131 for a Refugee Travel Document after I leave the United States?
You should file a Form I-131 for a Refugee Travel Document before you leave the United States. We recommend that you file the form no less than 60 days before you leave the United States. If you do not file for a Refugee Travel Document before you leave the United States, a USCIS office overseas has discretion to accept your application. You may only apply if you have been outside the United States for less than 1 year at the time of filing. You should not, however, assume that an overseas office will automatically exercise this discretion, particularly if it is evident that you could have filed your Form I-131 before you left the United States.
