10 Months Outside USA

Hey,

I spent 10 months outside USA, after 5 months I back for one day to avoid being outside for 6 months or more.

Will the officer accept this trip as less than 6 months or he will consider it as 10 months trip? During these months I have a bank account, credit card, driver license, lease.

Thanks

Nobody knows what the officer will decide. If questioned, you have to explain why these trips didn't break continuous residence. If they're your only long trips, it's possible you'll be ok.

I have a friend who left the US in 1985 (greencards didnt have expiration date back then) and came back in 2005 with no questions asked!! applied for citizenship a year and now he is USC.
Each case is different, I was very worried about my 3 trips to outside US, each lasted 11.5 months but interview was very smooth and dint have problem with these trips BUT I wait full five years after my last 11.5 months trip then applied for citizenship.

Your friend would not have been allowed back in to the country if he/she had been asked and told the truth. And, all trips since becoming an LPR must be listed on the N400. In this case, your friend MUST have lied, because a 20-year trip would have invalidated his/her LPR status.

Also, if the OP decides to wait a while, then it would be much better, but if he/she can afford to apply now and NEEDS to apply, then chances of approval aren't too bad, but not 100%.

From my personal experience, I would suggest that let all the questionable long trips outside USA age at least 5 years before you apply. This may not be necessary and I also happen to know people who have been granted USC inspite of not doing so, but I think my suggestion certainly simplifies.

I was out of US for 3 years between 2003-2006. When I went for USC interview about 2 months back, the officer told me that he didn't care about those trips since those were at least 5 years old.
