10-day rule for H1B visa

Hi everyone,

I need advice regarding 10-day rule for H1B visa. My employment start date will be July 1st, 2008, but I must attend the mandatory orientation on June 17th, so I need to enter the US on June 16th or 15th. Please advise me how to handle this issue. Can I show the orientation letter from my employer to the Border Officer to get an earlier entry?

If you enter on VWP remember that you cannot change status. On B you might be able to COS to H. However, the safest approach would be to re-enter in H status. You don't have to return to your home country. Mexico or Canada are fine too.

Unfortunately, my B1/B2 visa has expired and the consular officer said that she cannot issue a new B1/B2 and H1B at a time.

By the way, I've just found out I-192 form (Application for Advance Permission to Enter as Nonimmigrant) on the CBP website. Don't know much about this. What do you guys think? Can I use this form to apply for my earlier entry?
