Waiting from April 9, 2004
Two inquires, two LUDs. Both responses say - "waiting for the original file". The original applicant's 140 was withdrawn 2 months after it was filed. So it did not get approved. My application was filed with a copy of the labor and the withdrawal letter.
Same problem here
140 RD - April 09 (EB2 substitution case with a copy of original labor - staff engineer - MS + 3 year exp.). Original 140 was withdrawn before it was approved.
Did 2 inquiries. In response to the 2nd one, USCIS said they are waiting for the original labor. Who knows how...
I'm with you

Could you guys share information about the nature of substitution?
1) Whether there was ever a 140 filed with the original labor?
2) If there was one, whether the original's 140 was marked with consular processing or 485?
3) Whether the original's 140 was approved?
I am sure they do not...
Are any of you using a substitute labor?
I got the same message as a result of the enquiry and my lawyer thinks it indicates they are trying to locate the original labor cert.
Not sure if she is guessing, but there shouldn't be anything else that's wrong with my company - public, more than...
One question about the labor substitution scenario
Would you expect USCIS to wait until they get hold of the original Labor cert before they issue an RFE (for ability to pay, education, experience whatever reasons) or will you expect them to issue it while they are still waiting ?
The...
I don't think CSC is doing 140/485 concurrently any more
for semi-concurrent applications. One of my coworkers got his 140 approved a couple of weeks ago, but has not got 485 approved yet. So logically they should not hold up 140 for name checks.
According to my lawyer, USCIS requests DOL for it
From her email -
"Technically the process at the USCIS, is for the officer to request a copy
of the approved Labor Certification to the Department of Labor (DOL). The
delay tends to occur on the DOL side. They have to retrieve the file...
yes, probably inquiries are useless
They do things at their own pace. But the LUD change was a little bit comforting as it means they have not completely lost the application. I think my case is getting delayed because 140 was filed without the original labor cert and they are trying to get the...
Do inquiries typically cause a LUD change?
I got a LUD change on my pending 140 (April 6, 2004) yesterday. Was just wondering if it was triggered by the inquiry my lawyer initiated on 26th after we saw the new 140 dates.
Applying without the original labor is not a problem in itself
It may take a little bit longer as USCIS will find the I140 application which has the original labor and attach the labor cert to your 140 application. My 140 has been filed with a copy of the labor certification and a copy of the...
Nothing here either
April 9. EB2 labor sub. I am beginning to think my case is taking longer than usual because it was filed with a copy of the original labor. Are any of you using a labor sub with or without the original?
I got EAD/AP within a month after filing without original LC
My company had filed for one 140 application and subsequently withdrew it. They did not get back the original LC and filed my 140 with a copy of the labor sub and a copy of the withdrawal letter.
Though there has been no update on...
Does Labor sub without Original always take longer than the norm?
Or is it only in some cases where they have misplaced the original ? I am getting a bit worried. There was a 140 filed with the original labor which was withdrawn subsequently after a month or so. But since my company did not get...
01/10 LUD updated here too
I do not think it means much since 140 has not been updated. I did not have the previous 10/27 mass update though.
EB2, semi concurrent labor-sub. 04/09 - 140 ND.
