My 140 was filed with sub labor (EB2) in the last week of Sept 2005.
If you check the processing times now at the VSC, they are processing the January 08 2006 cases.
So any idea what the deal is here? They are processing cases which were filed about 3 months after mine was filed...

My labor certification is filed under old method under EB3.
I know that means my priority date has to be current for 140 filing.
Does the lower priority date under EB3 affect me if I go for Consular Processing? I think I know that it does for 485 application.

We appealed the case within 30 days AND filed for a new H1 extension application called Nunc-Pro-Tunc. Nonc Pro Tunc is basically, applying for H1 extension late under certain special circumstances.

Yeah, they did attach LC receipt that they got from labor department. The reason on the denial letter was that its filed like 3 months earlier than 365 days timelines.
The thing is, if they had got back early, then we would have been able to respond with a new file but they...

Yep its Feb 4 2004.
Apparently, there is new information on AILA.org (paid section). The document number is 04072763 dated July 27 2004 which throws a lot of light on this issue.

Why do you think the appeal will be denied? Do you have a history of such a case where it was denied? If we prove that it labor was pending for more than a year when my H1 was expiriring, is it not sufficient?
