Situation -
* Labor for greencard pending for two years (attorney screwed up and filed under EB3)
* MBA plus 6 years of experience
* I am close to getting into 8th year of my H1 (already have approval for that)
Questions -
A) Can I file for the new labor certification under PERM (hopefully under EB2 or whatever is now equivalent of that) now given one labor certification is already pending?
B) If yes, do I have to file under a new category job position?
C) What happens to my old pending labor application?
D) If the new PERM application gets rejected, how soon can it be re-applied? Does it impact my existing old labor application?
