Yes, all new applications will go to National Processing Centers after 01/01/2005 (or PERM after whenever it is implemented). But nobody knows for sure exactly how it is going to work and how much time it is going to take to process these new applications.
Going backwards... again
I just spoke with person at SESA and she was saying they are processing RIR cases on or before 02/03/2004, so they are going backwards again. I don't know what exactly is going on, any ideas??
- Most probably your application will go to NPC as a new application and not a backlogged application since it is relatively new one (if it was still unopened on Dec 31 2004)
Hmmm... it was quick. SESA (state) is working on Jan 2004 cases currently. It would be 4-6 more months otherwise, may be they are favoring people with your skills.
Actually yes. Whatever info I read about BRC so far, CA was never on the list. But answers by attorneys (in other forums) indicated that "eventually" they will take on all cases (including CA), but CA doesn’t seem to be picked up in near future.

Nirvan is from AZ and not from CA. Even though its San Fran. DOL, the LC processing time is different for CA and non-CA states. So if you are from CA, your processing time won't relate with Nirvan's.
I don't know if PERM is going to help or not. Most probably it won't help old cases. But there is 'Backlog reduction program', which is supposed be already in place by now. They claim that in 2 years all the pending cases (nationwide-310000 including regular/rir), should be cleared. But I don't...

Entered US on 26th APR 1999.
6 Yrs completing on 26th APR 2005.
Current H1 valid till March 25th 2005
LC filed on March 29th 2004
So I am eligible for 7th Yr extension (LC will be pending for > 365 days) - which can be filed 180 days before expiration of 6th year...

The assessment notice form SWA are mostly related to prevailing wage (It happens generally if salary mentioned in application is lower than prevailing wage for your position and even 5% variance might not be accepted). There can always be other reasons for the assessment notice...
