Thanks for your help on this. Here is my case
Started working with company A who sponsored my H1B and GC. I left company A to work for Company B, using EAD. Didn't transfer H1B. GC was under EB3 India born, so I don't expect to get any time soon. Now I got married and want to bring my wife. I...
But USCIS website says
"This means that you do not have to submit a separate Form I-130, Petition for Alien Relative, for your spouse, and your spouse will not have to wait any extra time for a visa number to become available"
That means visa number doesn't matter isn't it?
01/26/2005: Good News for Visa Movement
AILA has reported the DOS advised AILA that "thanks? to" the decrease in demand for EB visa numbers from USCIS I-485 cases and 245(i) labor cases still being held in the Department of Labor, the visa number would progress forward as follows:
Worldwide...
You are eligible for greencard if at the time of your i-485 (not during the time its pending approval) approval you have a permanent job offer which is same or similar to labor application. Till you get your 485 gets approved your status will be pending adjustment of status.
I totally disagree with opinion expressed in this thread. GC is for future employment and if you have EAD, you are eligible for unemployment insurance. You should make sure that you have a smiliar job as in your labor certificate by the time your 485 gets approved. You claiming the benefits of...
My sympothy for your situation.
But what were you thinking when you were filing your wife's i-485? You intentionally try to fraud the system and You should have thought what you are going to do if you were get cought. Its too late for you to think about what to do except follow the law. Sorry...
First of all, there are many more professionals other than Tech "workers" who are affected by retrogression and creating a group as tech workers won't help you unite people.
Secondly, Tech "workers" shows low estime..you guys are professionals not workers.
As far as retrogression is...

In order to maximize availability of the EB-3 visa numbers for the Schedule A occupations, when the regular EB-3 visa numbers are available for certain Schedule A EB-3 applicants, they will take out the numbers from the regular EB-3 numbers first. Accordingly, practically more numbers than...
I don't understand whats so urgent about this question...you are just curious. Please refrain from using Urgent when you don't mean it..it will lose its meaning and when someone really need urgent help they will not get one.
o.k many posters here think I am crazy. But I don't mind if PD doesn't move. Because I have EAD which allows me to work for anyone (similar job description) or don't work at all. I am single so I will have more time to find a life partner. I have no plan to stay in US for more than 3 years from...
I am one more CPA but I am more on corporate side like united nation. But I agree with United nation that immigration expenses are deductible as miscellaneous deduction, as thats a job related expenses. Without paying that amount you won't be qualified to earn the income you are paying tax on...
I should have been more clear. What I meant was, girl comes to US and than marry after few months. Than she applies for AOS based on Marriage (basically she gives up her h1 or f1 or l1 status and apply for permanent residence based on spouses GC). Will she be allowed to stay in US or she has to...
what if GC holder get engaged to a girl and girl comes to US using F1 or H1 or L1. And than marry in US. Will she be allowed to remain in the US without restriction on travel?
It is definately not political reply. Because when I contacted congressman, he wrote to me that NSC process in order it received and I will receive notice from NSC in duecourse. It never mentioned anything about 90 days or not being processed Nov cases. I am guessing they did talk to USCIS .
Its advisable not to send letter before I-140 is approved...just wait till your I 140 approved...you might get i140 without RFE. There is no point in sending AC21 letter unless you get a RFE...
