sam70, along with other supporting docs, maybe you can send a letter from your son's surgeon stating that your son will have surgery. and you can write a letter saying that it would be helpful to have your mom during the surgery.. betsy

my lawyer said that priority date retrogression for people already filed I485 (from india, china and phillipines) means that their 485 will NOT be processed until their PD is current. there is no PD on my I485 either but there was a PD of june02 in my I140 approval receipt. betsy

I doubt that is the case. there are many RFE respondents who have been waiting 4-5 months and not seen any activity in their cases after RFE has been received by NSC and the only reason is beacuse their PD is not current. betsy

congrats! LC pd should not affect eb2 cases. so it is immaterial when his pd was.

yep, I was wondering the same thing. our PD is june 2002 and EB3 I485 is May2003. we got an RFE in dec2004 which was replied in Feb2005. with the PD retrogression, i doubt that they may review the file. but it is NSC so you can never tell. has anyone with EB3 application with PD beyond...
