My situation is as follows:
1) approved RIR labor 2002
2) approved perm labor 2005
3) approved i-140 2006 (PD 2005)
4) ALL of above for company-A. 2006 company-B took over.
My lawyer said i cannot file and have to start again with new labor as merger/acquistion was 'asset only'...

Ok so based on my status as listed in this thread, i just noticed that my old company A approved EB3 labor + I-140 is current...so can i apply for i-485 with the supporting documentations of company name change ? OR DO I HAVE TO START FROM SCRATCH :(
Thanks InfoGuy, not sure what you mean by feedback on I-140. The old company was merged with the new company. However, it was only an asset transfer I think. The three years H1 extension I got was because of the valid I-140.

My attorney said that the acquisation/sale was such that in legal terms it does not qualify for "successor-in-interest".
Can I still use my approved i-140 with the old company and apply for 3 year's extension plus transfer to the new company ?

what sort of amendment forms is available to send USCIS ? same for H1+ LC ?
Also, would it be applicable for pending I-140 and the merger has taken place before approval ? Do i need to send any amendments for I-140 + H1 + LC then?

I am in the excatly same situation except that my I-140 is not approved yet. i read in some other thread that an ammendent notice needs to be sent as the TAX-ID would have changed for the new company. Let me know if you found out more from your lawyer. Thanks

this is what my lawyer said to the question of converting from EB3 to EB2:
"No, even at the labor certification stage we would have to re-file a new
petition, start all over. EB2 is also backlogged at this time."
I don't follow earlier poster as to how you can keep your PD when you file a...

Just learned today that all the stuff of my small agent company have been laid off. I spoke to the owner and he said all is ok. But I supect he may be planning to close it down (chap.11/13 ?)

Need some advice what to do. My H1 extension is pending since Oct.05. Also I-140 is pending since Aug.05. My current DL will expire in a months time. Will my DL be renewed based on filled H1 recipt in NJ ? Will they renew it for at least 3 months ? or....

Finally the night mare is over, got the approval after going through a roller-coaster ride with INS:
1)applied in Jan 04, no response for next 7 months.
2)employer initiated first query in August, no response after 30days
3)employer initiated second query at the end of 30 days.
4)changed...
7th year extension...7th month and still waiting...
My lawyer even put in a status inquiry and that too has passed 30 days and no reply/update from the INS.
I guess they are just waiting for the 1000 bucks from me :rolleyes: Can't wait any longer as I am left with little choice but to...
