Company Acquired. What would bethe impact on GC

Dear GC Gurus

I am not sure I need to concern for this or Not. My company filed my EB2 and got approved in Nov05. During December05, they filed 140 and was approved mid of Feb.06. Now, my company was taken over by a much bigger company (speaking around 300 Million$) with effect from April 1st.

I wonder, wheather the labor and 140 which were approved in my name with my previous company name are valid any more with the new company. Currently I am waiting the PD to become current for Nov05 EB2 category. Donot know when.

My previous company says, there would not be any impact on the immigration and they are not even filing a new /revised H1 for me. The Official Takeover happend after 40 days of my 140 approval.


At this point in time, can any one of you advise me, whether my case is safe, or do I have to findout an alternative.

Did any one of you go through similar situation. If so Appreciate your advise. :)

Our Company is a very friendly company and pro - employee oriented.

Just wanted to know how it works out.

No impact. Not harmful anyway. I believe AC21 also covers acquisitions and there was a Yates memo clarification on this as well, your non-immigrant and immigrant visas would be ported to the acquiring company. I was in a similar situation once but just with the H1 status involved, no green card issues and my status was not impacted, it was a seamless acquisition so far as I was concerned.

I am in the excatly same situation except that my I-140 is not approved yet. i read in some other thread that an ammendent notice needs to be sent as the TAX-ID would have changed for the new company. Let me know if you found out more from your lawyer. Thanks

Hello abhathakur, Did you filed for AC21? In my case my Company which was subsidiary of another has now become independent public corporation and has also changed it's name - what should I do?

Did your lawer file any document to change company ID #? I have a same case with you, but my lawer tell me not doing anything, just wait for the approval of I-140, and when filing I-485, I have to have document to support my prior's company still existing except changing name.
