I applied for 3-year H1B extension based on 140 approval. But the I-797 approval notice I received only has 1 year instead of 3 years. I think the VO didn't even read my forms. How can I correct it? Is there any specific form my employer should fill out? Or I can just ask my employer to...
Just want to report back that TSC mailed out the approved notice today. The receipt date is 12/12/06. On 12/26 TSC mailed out a RFE asking for an original document (my lawyer had sent the copy). It is regular processing for EB3.

Depends. They can either give you a 5-year visa or 3-month visa. I did 1.5 years ago - just told them my current situation and that I will go to Australia permently. I think it took 1-2 months to get their decision.
VA RIR Labor Approved
Dear All:
My employer received the labor approval letter from PBEC today. The approval is dated June 5 and we just knew it today.
I sincerely wish all of you will come out of this insane labor pain soon.

Thanks for your reply. I filed LC EB3 in Dec 2002 and am thinking about filing PERM under EB2. How much did your lawyer charge you for the PERM filing only?
Did you file PERM through a lawyer or you did it yourself? I don't know if anyone has done PERM without a lawyer and would really like to hear some experience on that. How long did it take you to prepare for the PERM document inclucing ads? Thanks.
EB2/EB3 question
I know this question might not make much sense but I'm still curious. I have a Master degree. In the LC recruiting ad, we put "minimum Bachelor degree. Master degree is preferred". I don't know why we didn't put "master degree required". Maybe salary offered is not high...
You have waited for almost 4 years and you still don't have the LC approval. You are still saying the US government is very efficient??? What's wrong with you?
I also got my screen shot. Everything else is fine except for nationality. I'm from P.R. China and PBEC put me under Taiwan. I don't know if it's worth having my lawyer correct with PBEC. Any comments?
GC salary is for future employment but your current salary is directly related to the GC salary. INS knows some employers only put on paper a salary and they might actually not pay that salary. That's why they will ask us to submit paystubs or W2s to verify salary history during the GC...
I understand what you are saying here about your options to continue the LC process. However, to raise the salary only on paper might give you trouble later on when your GC applications is being processed. INS will ask you to produce your W2s from previous years and when they find you were not...
My case is RIR. My suggestion is to talk to your lawyer first. What we did about survey is my lawyer found a survey company who has an existing compensation survey we can use. You lawyer will be able to tell you if survey might work for your case. I have a friend who also got similaor...
Hi gc212:
The deficiency letter indidated there are 2 options: 1. to increase the offer wage to meet the prevailing wage. 2. to submit a professional survey to show a different prevailing page (lower, of course). What we did is to submit the survey to show the actual wage offered is not as...

I am curious too about your RFE. What was it about and how your lawyer responded it? Also, how did you know VEC forwarded it to Philly Regional? Did VEC notify you or your lawyer found it out through regaional? Please share your experience. Thanks!
