May be this'll help Let me clarify something once and for all. After the labor gets cleared ,you have to apply for I140/485.But you cannot file 485 till the visa dates become available. Now if by chance the visa dates become available but you were unlucky enough to be in PBEC and your labor...

The main problem is that we take things for granted.Things that are not fair.The whole BEC system was made to cater to the FIFO and to be fair.I don't see how we can sit and watch and do nothing and just talk and take the bull----. :mad:

Well I recd my reply the next day.Status was the same.

change BEC Is it possible to change BEC (from Phili to Dallas).I filed in CA and half the cases went to both the BECs.Dallas is adjudicating 2003 whereas Phili is still stuck with 2001-2002.Is it possible to change the BEC? Can I ask my lawyer to do that?

screen shot from ca I emailed them in the month of August and received the following along with my other information.It was "awaiting processing" then and I do not want to send them too many emails as it clogs the system and reduces their efficiency(if you can call them efficient at all)...

So what you are saying if a case successfully goes through the labour certification (say in about next 6 months)but 140 is still pending and the 485 can not be applied for(since the visa dates are not available), the person can be granted any # of extensions.
