Al Southner is right, your being out of status will not be an issue in your wife's naturalization as long as you tell the truth. My husband has been an overstay since 2005 but this was never asked during the interview. Just put "B2 Overstay" or ""Out of status" and you should be fine.
Thanks Triple Citizen. I will go ahead and renew my passport while waiting for the fingerprint and interview. I can get a certification for ID purposes from my country's embassy while I wait for the new passport.
Hi to all. My husband filed his AOS a few days ago but his passport expired yesterday. We can't renew his passport until we receive the NOA for the AOS and it will take 6 weeks to process the new passport. His passport is his only government issued ID. We are worried that we might not get his...
Hi. I recently became a USC and filed an AOS for my husband based on the approved I-130 I filed when I was still an LPR. The I-130 was filed in July of 2005. Does having a current I-130 priority date make the AOS processing faster as compared to filing I-485 and I-130 concurrently? Thanks.
Like you I was worried about the fact that my spouse has overstayed his B2 for almost 5 years. Last thing you want to do is to lie about it. Disclose that he is B2 overstay and give your address, assuming you live together. This issue was never raised before or during my interview. Just be...
I don't think there's a need for translation because the birth certificate is in English. Thanks for the replies guys. I will mail everything on Tuesday since tomorrow is a hoiliday.
I am getting ready to file an AOS for my spouse. Here's my checklist. Am I missing something? Any feedback is appreciated.
1. Check payment in the amount of $1,010. Filing Fee and Biometrics Fee
2. Form I-485
a. Copy of I-130 Approval Notice
b. Copy of Petitioner Naturalization...
Thanks for your replies. My husband and I have been waiting for almost 5 years for this. He has been out of work since he got here, being a good stay at home dad to our 4 year old son. He is just excited to finally be able to work, drive and travel. We are almost done with his AOS packet. He...
Atanase,
Did your wife get her GC through adjustment of status? Did she have any issues because she overstayed? I'd like to know because my husband is going to file his AOS this week. He has overstayed for almost 5 years and from what I've read the overstay is a non-issue once the petitioner...
Just an update. I had my interview today and everything went smooth and easy. The officer was very nice and not intimidating at all. Got at the Newark DO at 12:30 and was out the door at 4:30. Good luck to those who are having their interview soon.
Paul K,
I am now an American Citizen!! The interview itself was very short and smooth, but the wait before and after the interview was quite long. Newark DO has same day oath so it wasn't that bad. Got at the office at 12:30 and was out at 4:30. No questions were asked regarding status of...
Actually the AOS is for my husband and the N400 is for me. I have my N400 interview this week and I am anticipating a favorable outcome so we are preparing the papers needed for his AOS.
Hello everyone. Can I file my AOS with a courtesy copy of I-130 approval? Has anyone done this? I filed the I-130 five years ago and I think my lawyer has the original. I want to file it myself this time and needless to say I don't want to contact my lawyer. Thanks.
PaulK,
I will have my interview on January 13 and perhaps take oath on the same day. Everything is going well so far, keeping my fingers crossed. I will be back to share my interview experience. Good luck to you.
toma1234 and NXM1,
Three of us got our email update today and hopefully the IL soon. No YL for me either. Good luck to us. I'll post as soon as I get my IL.
