Please consult a good lawyer. My suggestion is to ask your lawyer to explain fully to INS and to send $1000 penalty to use 245(i) simultaneously. In this way, you may save a lot of time. Recently, most 245(i) cases are sent to local offices. However, if you explain to INS the special...

Do not worry. it could be a simple thing. In most of cases, INS sends this notice to check your status history if the necessary documents are not in your application. Once you supply INS with the requested documents, your case will be approved right away.

Congratulation Yo Yo on the final freedom that you deserve for a long time. Just learned an interesting fact from a GAO report, only about 5-6 officers routinely working on I-485 at Vermont service center for the fiscal year of 2000. They increase the adjudication resource this year...

Sure you can use either documents to travel. However INS recommends you to keep work and travel authorization corresponding. If you use AP for traveling, it is better to use EAD for working or at least having an EAD. Otherwise there may be adversary effects on you I-485. Who knows...

I don\'t think so. DOS controls visa availability instead of INS. We have seen a lot of EB2 cases with later PDs than yours. It is very possible that INS misclassified you as EB3. Next time ask IIO what categeory INS put you in.

You got a very special case. If you argue your case before INS and I believe you will eventually win. But that may spell a dealy of several may-be-sleepless months. I suggest you find a doctor in your current ared and redo it. $700 is a big number. Your freedom weighs heavier than...

Medical Examination
All applicants for adjustment of status are required to have a medical examination. Results of the medical examination are valid for 1 year before you file I-485. After you file I-485, they are valid forever as long as...
