    EB1a NSC self-petition RFE - Help

I have to agree with tampaboy, I also get a sense that IO was not satisfied with the contents of reco letters. Each referee should write a letter which specifically discusses one (or some) aspect of your contribution. In my case, lawyers drafted the letters in such a way that each letter has...

    Need advice on EB1 (EA)

Unfortunately, IMHO, your chances are very slim. If decided to go for EB1-EA, I would suggest going through a lawyer so your case would be well prepared and well presented. I can also add that waiting another year to get more citations and have much more reviews would help a lot.

    EB1 or Not?

Depending on number of reviews and number of out of loop citations, you might have a chance for EB1-OR. Paper wise you are doing good, citations are marginal so number of reviews plays a major role here. If that number is on the 20 side, you have very good chance of getting your EB1-OR approved...

    I-140 approved howlong for EAD

Is this a concurrent case? If so, you should hear something by the end of 3rd month, if not you can call them. If it is not concurrent, then I assume you have applied for EAD which takes 3 months from the day you filed (or they received as they claim).

NIW - Mechanical Engineering with Previous IT experience

As things stand now, I would say unfortunately your chances are slim. EB1-OR is a good option though. In engineering, applicants usually go for scholarly article, contribution to the field, and judge of work of peers. I can see how you could satisfy the first criterion but not others. In any...

    NIW self petition question

I second Concerned4us. You are most likely to be told to hold off for another year in which you can build up your case. However, I have seen well-prepared cases with not-so-great credentials to go through, so building your case is VERY important.

I-140 approved but I am leaving the country. What to do?

I assume you are not from retrogressed countries and that means you are current with EB2. My case took around 70 days to get the approval and around 85 days to receive the card. took 30 days to receive the package and another 20 days to get the fingerprinting done. At the time of FP you should...

    Submitting tax return with I-485

Filed through lawyer and they asked me to submit tax returns. Did not ask why, but have a feeling that submitting it can show your marriage is bona fide and maybe make sure that you were doing the thing the correct way. IMHO, does not hurt to send. Consult a lawyer.

    EB1A Credentials evaluation

Although you have excellent resume, but it falls short when you have to prove to meet at least three of those 10 criteria. You definitely meet two and that's why above fellow was suggesting EB1-OR. I suggest you get 20 more reviews to make sure that your case is well established (and...

EB1-EA or NIW and clarifications needed

of course EB1-OR would be easier to obtain but IMHO you have a decent chance. Focus on contribution to the field, scholarly articles, and reviewer+membership (it would be a lot better if you had 20 reviews)

    Letters for EB1 application

i submitted 8 letters with a lot of diversity amongst the references. couple from outside of US, others in US. mostly non american. i assume the most important point is that they should be top of their field (and perhaps your field) so their letters bears more importance. of course this only my...

who should I obtain letters from?

in my case, i went with five individuals that knew me and three individuals that did not know me but could judge me based on my CV. i've heard that this is important to show the strength of your application.

    Question regarding I-485

Thanks ginnu for clarifications. I have searched section 306 in the past but could not find any useful info as how to address it. Maybe my search was not comprehensive enough. Will do again. Best,

    Question regarding I-485

Hi Gurus, I have an approved I-140 (EB1) and has already submitted my I-485. My parent went for a visitor visa some time ago and both were rejected. In the letter of rejection the reason was inadmissibility under section 306 of enhanced border security. Is it going to be a problem for my...

kindly reply - EB1-EA or EB2-NIW green card?

you are well qualified for both. i agree with adi76 and in addition i recommend you to prepare your case with a lawyer (a well prepared case goes through without any problem/RFE)

kindly reply - EB1-EA or EB2-NIW green card?

you have good chances with EB1-EA, but of course IO can be harsh and issue RFE for contribution to the field (if your citations are high, then probably you wouldnt have that problem) .... If I were you, I woulda gone for all three EB1-EA, EB2-NIW, and EB1-OR (in that order)

    EB-1 EA Criteria

I think your chances are good. A well-prepared case is very likely to go through. IMHO, mention all the above in your petition but focus on citation, reviewer, and publication and fit them to judge of work of others, scholarly publication and field contribution. Good luck.
