Hello All!
I am an Indian citizen. I am planning to do a round trip to India using my Advance Parole.
I am taking KLM and it stops at Amsterdam.
Do I need a transit visa for Amsterdam?
Has any traveled like this without transit visa?
Thanks,
Mtsaha
Thanks BigJoe!
So I assume that unless I commit some violation (like staying in US when out of status, crime, etc.), it is un-likely that I will be denied entry! I have done google search and have not found
a single case yet when someone (with AP remaining valid, I-485 still pending, and no...
Hello All!
Happy New Year to all of you!
I am planning a month trip to India from US. I just want to make sure that I know the situation well.
I came to US with F1 visa. I have been on F1 for 5 years, OPT for 1 year, H1 for 1 year, and then pending Adjustment of Status for the last 2...
Hello,
I have advance parole from my pending I-485. My status pending I-485 and I am working with my EAD. I want to visit India. Can I go for 1 month? What is the maximum allowed absence from USA while I-485 is pending and advance parole is valid?
I do not remember what I entered for...

Dear All,
My NIW got apptoved in August 2008 (applied July 2007). My I-485
has been pending since July 2007 (concurrent filing). From next week
I will be jobless. Will this joblessness create a problem in the
adjunction of i-485??
Many Thanks,
Mtsaha
Hello,
I am reading the instructions for filing I-129:
www.uscis.gov/files/form/i-129instr.pdf
I dont see where it is written that a person cannot change his status to H1B
by filing a new H1B petition while in US under the parole status.
Then how did you conclude your claim "dryheat"...
Hello All,
Currently I am in the US on parole status working on a job using EAD.
Suppose I get a new job and my
new job files for an H1B. Then suppose my H1B is approved, will my status
be automatically changed to H1B from parole? Or will I have to leave
US, get a H1B visa stamp, and...
Hello All,
I self e-filed two I-140's under EB1A and EB2-NIW on July 24, 2007.
Last month both my case were transfered to NSC.
I had concurrently filed for I-485 along with EB2-NIW, which
had gone to NSC.
Has anyone else experienced this kind of transfer??
I am wondering if this kind...
actually i want to correct myself.
I think if your new H1B is approved while you are working on EAD, then you are back in H1B status. After you are back in H1B status stop working with EAD.
It dosnt invaildate the H1B approval. But it knocks off the H1B STATUS.
From
http://www.murthy.com/news/n_efftrv.html
it seems one can indeed work without EAD. But what happens if one's
i-485 is denied? Does the person then has to instantly leave US,
as he/she would be then out of status??
Watch out!! you loose your H1B STATUS if you use advance parole!!
So to continue your employment you will have to use EAD.
If you think your i-485 would not be denied before you get the next chance
to get a visa stamp, then its fine, else its like a hanging sword.
Very Big Congratulations!!
Can you please tell me who your lawyer was?
If you cannot reveal it here due to privacy sake, you may

Feel free to reply me back here in the forum if you emailed me.
Many Thanks and congratulations once again!!
Hello,
Someone told me that when a I-485 denial notice is issued it gives
a time frame to leave the country. Is it true?? Does anyone know how the
denial notice looks like?
Many Thanks!!
Hello All!
I have heard, if there is a RFE on one's I-140 case, then concurrently filed I-485 is put
on hold which in turns puts hold on issuance of new EAD and AP. Is this true??
If this true then if you already have an EAD, can you still use it or it also becomes
invalid if there is a...
Hello All,
Its been now 9 months that I e-filed my I-140 under EB1-EA.
The case first went to TSC. This month it got moved to NSC.
Ever since i filed my case, my resume has improved significantly.
I am wondering if it is advisable to send additional supporting documents
at this stage...
Hello All,
My e-filed EB1-EA went to TSC about 9 months ago.
This month, they have moved it to NSC (probably because i live in CA).
Now I see that in NSC the processing time of EB1-EA is about 18 months.
So should I expect results in 18 months or just 9 months as I application
has...
