Indian consulate in US issues birth cirtificate for people born in US and have opted for Indian citizenship. They do not entertain BC requests for people born in India. You will need to get a BC from muncipality or a certificate of non availability. Quite a few of the states have streamlined...

I had a simlar situvation, Case transferred from VSC to TSC...got 2 FP on 9th May and GC approved on 28th June.

Along with the affidavit, you will also need a certificate of non availability of BC from the muncipality in India where you were born. Mere affidavit does not serve the purpose.

Folks - wanted to share with you that I received my GC approval email on 06/28 Applied I 140 and I 485 during June 2005 using a preapproved labor on EB3 with a PD of Sept'01. FP during July 05 and Mar'07. Wishing good luck to all people in the wait list
