Happy new year everyone!
I'm in a complicated position and I need some advice.
Here's me story:
I am getting married in a little over 2 weeks here in the US to my girlfriend of 4 years (who is a US citizen). I just discovered from HR yesterday that the company lawyer had...
I recieved my I 797 in the mail 3 weeks ago but they made a mistake with my country of birth (listed it as my country of citizenship, however the two are different). I reported the mistake to USCIS customer support. I recieved an email alert from USCIS a few days ago saying this:
Receipt...
Hey y'all,
After the tedious h1b process, I finally got the hard copy of my approved h1b petition. Only problem is USCIS messed up my "COB". Now I'm guessing COB means Country of Birth. Anyway, I'm a Canadian citizen however I was born in India. On my approved petition however, my COB has...

Hello! Thank you for replying :)
I am on OPT now and my I-129 has been approved. So I guess it's safe to visit and come back by the end of June right? I hear so many mixed responses about travel during that period. None from the Canadians though so thanks for replying.

they recieved it on april 19th. receipted it on april 24th. approved it on may 3rd (though they didn't update my status on the uscis website. it still says case pending). Finally on may 24th, my lawyers got the approval notice and today may 30 I got the physical copy. phew!
it was non...
Hi,
I'm Canadian eh, and I just finished my masters and am on my OPT. I just had my h1b approved and am aware that it'll kick in on Oct 1st. In the meantime, I want to travel back to Canada for a few weeks to see my family, friends, etc. I am aware that Canadians do not have to get their H1b...
Update
I just recieved confirmation from my company today that my H1 petition under the masters quota was approved. I applied with just a letter of completion.
As an australian citizen, you won't even need to go through the H1B mess. Aussies have a separate visa category called E-3 visa. It's fairly staight forward, similar to the H1B is most respects.
why are you wasting precious H1Bs when so many people are forced to abandon their plans because of the lottery? It's a shame that you'd do that to your employers as well. They would've spent alot of money on your applications only to have you walk away.

You guys,
I forgot to mention - another posibility is that USCIS won't straight out reject your application. Instead they will issue you an RFE (request for evidence) requiring you to submit additional proof that your degree has been completed. In that case...
Hi nagiamar,
Didn't mean to alarm you. The reason why I said that your application could be rejected is because according to my lawyers, USCIS wants letter of completions to state that all degree requirements have been met and that just the actual degree conferment alone is left.
I was in...
Hi,
Well, I applied with a letter of completion and not the actual degree. Also, I never submitted my OPT (EAD) card with my petition. My lawyers said it wasn't necessary at the time, though I've heard of people being RFE'd for EAD cards on this forum.
For those who have receieved an H1B under the masters quota. If you have ever been given an RFE, what documents do they usually want? After sending in your documents, how long does it take for them to make a decision?
it's very much possible. i know many people who were receipted on april 24th and were approved on may 3rd. i was receipted myself on april 24th. my case is still pending though, however on may 3rd there was some internal update on my case according to the USCIS site.
did you apply under the...
Many of my friends who were receipted on April 24th have already been approved for their h1b. I've signed up for updates on the USCIS website, and it tells me that on May 3rd my file was updated internally at USCIS, but my status is still pending. I'm waiting to hear back on my case, any idea...
