where can I find info in the exact rules and regulation on this? Also I need to find the definition of "out-of-status". I tried looking up USCIS but I was unable to find it.
If I am granted my h1-b but need to go back to my home country to get a visa and i-94. I am afraid that i will be blacklisted since I've been out of status for over 10 months. My lawyer told me it's ok to leave and come back, but I just need to make sure.
also wanted to add that my wife will become a citizen at the end of the year, and I should be able to get a green card. Is it worth risking to leave the country or should I just wait for another year. (I will need to find some under-table whatever job to get by)

congratulation! I am pending h-1 myself, and my wife will become a US citizen in Dec 2007. Basically I have 1 year where I am out of status, so it's good to hear good news. All I know is I am going to have a big ass party when I receive my green card after waiting for more than 16 years.
