USCIS blacklisted. What's the definition?

If I am granted my h1-b but need to go back to my home country to get a visa and i-94. I am afraid that i will be blacklisted since I've been out of status for over 10 months. My lawyer told me it's ok to leave and come back, but I just need to make sure.
 
your lawyer is telling wrong. you have been out of status fo more than 180 days so there is a 3 year ban on reentry, once your wife becomes us citizen then apply for your gc, once that is approved you can go out, if before that you are in trouble. GET A GOOD LAWYER.
 
where can I find info in the exact rules and regulation on this? Also I need to find the definition of "out-of-status". I tried looking up USCIS but I was unable to find it.
