Did you renew your H1 and forgot to renew their H4s?
Do they have valid and current I94? If thats the case don't worry you may need to pay $1000 fine for being out of status and will be approved.

It is based on Qualification and/or job expirence.
To apply under EB2 you should have either BS and 5 years of experience or MS and 3 years of experince. If you lack these conditions then you need to apply in EB3. It doesn't matter during AOS approval. It did matter when there was cutoff date...

someone on this board said that his I140 was approved last year during the same time INS was doing so called Audit. So it doesn't necessarily means the INS will stop working on the case during audit.

Employer can get you GC cancel
Employer can get it cancelled if he shows proof that your intention was not to work them even before getting the GC. He has to proof this by means of email (if you use company mail server for job soliciting) etc. In realty hardly any employer will go in litigation...
