Thanks for your help with previous question, another which may be helpful to the forum if answered...
There is a rule (I am pretty sure of) which relates to having to be resident in the state that you apply in, for 90 days.
Two Questions:
1. Is this 90 days ahead of the interview...
Not Disputing that - its sounds very plausible.
Clearly if there is a warrant for your arrest, this procedure is going to get you.
However, failing any larger issues being flagged, it would appear that discrepencies with dates (departures in this case, as arrivals are usually stamped on...
Yes, I was going to ask the same question. People think that each year has to be spent in the USA. My understanding is the *same*, its just a question of half the time in the USA over the 5 year period - not a restriction per year.
Consider the scenario:
* You are a Perm Resident
* UK national orginally
* You are applying for n400
* You satisfy the 5yr 30/60 months lookback rule for residency
* You have 4 trips to the UK for 5 months at a time in the last years
* None of these trips have been more then 6 months...
There has probably been much discussion on this, but to be clear. The trips abroad of no longer then 6 months are *not* limited in any one year. So if you can prove that you have significant ties to the USA and have taken two 5 months trips in one year - then you have not broken the residency...
Question
Was you stamped on the way out of the USA? How did she check the dep date on your old passport if you did not have a stamp? Do you know if they checked any other system to clarify your departures?
Welcome your response.
I am going to begin applying for N400.
Have recently renewed my passport. In the UK you have to send the old passport into the Home Office (UK Passport Authority) and then you get the old and a new one sent back to you.
I have *destroyed* the old passport and have no record of it with its...
i am going to ignore the flames as your footer suggests Joe F. and by the way the isp accounts aren't ours. my point is that it would be legitamate for an individual to be self employed and develop international trade/commerce on the basis of a N470, thus you don't have to work for a large...
Thanks. But failure of anyone reporting you working, there is little likelyhood of CIS investigating country specific tax returns outside of the USA? People and employers in other countries that you are already a national in would not be knowledgable about your USA status either (unless you tell...
Thanks JoeF.
I understand the symantics. the aim is to continue the right to reside and work here in the future, but take a break after sweating to get the green card. after spending years in silicon valley i can see how usa tech companies take advantage of visa based workers and how the...
Thanks for the help chaps. A couple more points of clarification...
1. If you combine visiting the USA every 6 months with filing for a re-entry permit prior to leaving (which will safeguard the GC), as well maintaing ties as much as possible (paying taxes etc..) one will be pretty much...
The topic of maintaining the card has been well discussed in this forum. Many of us would like the flexibility to take a break from the US when we have a green card but ensure those years count towards naturalization in the future.
On that topic...
I have seen a few threads where people...
