    i don't think that's entirely correct. i had thought that was the case when i didn't get my OL at the beginning of January. But I took oath on the 29 and my OL was sent out later in January.

    you have confused judicial review provision with the oath time limitation. 45 days judicial ceremony is in: INA §§ 310(a), (b), and (d); see also Immigration Act of 1990, Pub. L. No. 101-649, 104 Stat. 4978 (Nov. 29, 1990).

    My opinion he has all the clues. The statute mandate that an oath must be administered within 45 days of the initial approval. since apparently you have to go to a judicial ceremony, i assume there is a name change? by not approving you, he doesn't have to schedule you in 45 days. My guess.

    if you live in Los Angeles, New York, Chicago, or Detroit and other 44 so-called "exclusive jurisdictions." Name change won't cause delay at all, because in these cities, federal courts have asserted that they have exclusive authority to oath new citizens, and USCIS cannot conduct oath ceremony...

    Don't bother checking the online status. It is absolutely useless and it never changes other than telling you that they have received the application and sent you a notice blah blah blah.

    Your lawyer is correct. even if you could get the AP, don't go out if you overstayed your visa, the border officers can still deny your admission.

    You should file a motion to reconsider, and tell them that no notice was received. talk to a lawyer. i think you have to do that w/i 30 days.
