Hi folks, after studying how INS works from various immigration forum, I figured out a way to save an I-140 when you left your sponsoring company before you file I-485. Can the gurus here tell me whether this will work or not?
Thanks

A trick to file I-485 without your I-140...
Do you have substantial change in responsibility? Are you still doing the same duties described in LC? If so, you are fine. Salary can be a problem only if it is substantially lower than LC.
I remember their was a case at murthy.com saying an employer revoked an ex-employee's I-140 after 180 days. Then the guy's I-485 got denied. His lawyer fought it with the INS and eventually got approved. So my thinking is the employer can't do anything after 180 days because if they can, then...
To apply for EAD, you need to include a copy of your I-485 receipt. So ask your lawyer for a copy.
When I applied for EAD by myself, I even got an RFE for my I-140 approval notice. So to be on the safe side, ask your lawyer for your I-140 approval notice as well.
I was in the same boat. But I got approved! =)

I was scared to death when I got the RFE. Fortunately I got a nice job and everything works out fine.
I don't know...
Your employer can't mess up with your process. But they can disallow the company lawyer to release your file. In this case, you need to hire your own lawyer and they have to transfer your file to the new lawyer.
You can stay unemployed as long as you can. I there are no Employment RFE or...
I showed the Secretary of State record saying my ex-company is suspended to my Fragomen lawyer. Then they says they are now ok to continue my case without the company releasing my files. I need to pay $500 to retain their service.
I know how to use Google but it won't tell me whether this lawyer is good or not. That's why I need recommendation.
Among the lawyers you mentioned, only Fragomen is based in Silicon Valley. However, my sponsoring company already used them to represent me. And they still have tight control...
I am after 180 days and I get a new job. But my new employer can't hire me in a permanent basis until I get my green card. They can only hire me as a full-time temp first and turn me into a perm when my green card is approved.
Do you think an employment letter like the one below signed by...
I am one month into my Employment RFE. I was unemployed when got it. Now I get a full-time job. The lawyers hired by my ex-company says they need my ex-company to release my file to them such that they can represent me. However, my ex-company went under and the CEO is no where to be found...
Did you receive the RFE as well?
My RFE was issued on June 7th according to AVM. But I still haven\'t received anything. My attorney probably is not working for me anymore because my company went under.
Thanks for your reply
I am on W-2 as an hourly employee. I am full-time, too. I am just not very sure about how I should write the employment letter. I am curious, do you have an annual salary in your I-140?
Hi,
I may get an Employment RFE. I don\'t have a permanent job now (doing contract now). I am wondering what are the options I have if I can\'t respond to an Employment RFE within 90 days? Under current economic environment, it is quite possible. Am I doomed?
Thanks...
Anyone else had experience of like this?
I know it is a serious matter but I am really low in $$$. If someone did it before, it would be great if I can copy it...
It is a full-time contract job, so I believe the wordings in my draft is true to the facts. Is it possible to improve the...
Hi
I checked my AVM today and it says I will get an RFE. I haven\'t received anything from INS yet. But I suspect it might be an Employment RFE.
I was laid off on 1/31/02, a little bit more than 180 days from my RD 8/2/01. Since then I was unemployed...
