    Please help!! AC21 question

If there are no RFE/interview, you don't need to have a job at the time of approval. If there are, you need to have a similar job. AC21 explicitly states that you need to show you are not a public charge. The the safest way is to go find a job ASAP!

A trick to file I-485 without your I-140 sponsoring employer

I only have the SOP for 485. I believe for the interviews, you basically bring all the evidence that can support your case, ie employment letter, paystubs, W-2s, tax returns, proof of employer financial situation, etc. You may also want to bring the AC21 doc because some interviewers don't...

    laid off >180 days

Krishna02, Based on the posting I read from various immigration sites, Employment RFEs seldom asks for your employment letter, in most cases, they wants pay stubs, W-2s, proof of good financial health for your sponsoring company. I think my speed is normal. It took me 15 months total for...

A trick to file I-485 without your I-140 sponsoring employer

According to the official I-485 processing doc released by INS, the employment letter is not checked until the final stage. That means without it, you can get a I-485 receipt. That also implies my trick will work! ;) http://www.shihab.net/empimm/I485sop.pdf

A trick to file I-485 without your I-140 sponsoring employer

Re: Yee Man Chan(Thank You) 1Q)Do u think this is substantially lower for the employee A. The key is to have a job in similar category AND not be a public charge according to the literal meaning of AC21. 50-65k is definitely not a bad salary. So it shouldn't be in the public charge case...

A trick to file I-485 without your I-140 sponsoring employer

According to the link I posted, the denial (well, direct denial in this case) seems to be come as soon as the act of I-140 revocation. I think you just have to pray to God such that the bureaucracy at INS will slow down the I-140 revocation process. As long as the act of revocation is after 180...

A trick to file I-485 without your I-140 sponsoring employer

Hey folks, Check out this link. http://www.murthy.com/UD140rev.html It seems to me it is ok as long as the actual act of I-140 revocation by INS is after 180 days, you will be fine. It doesn't matter what time the employer requests to revoke. :)

A trick to file I-485 without your I-140 sponsoring employer

Re: I 140 pending LAID OFF URGENT Unless you obtain an H1B before your I-140 is approved, you will be out of status for a while because an adjustee status only applies to people with I-140 approved. Your best bet is to find a new job quickly and start over from the LC process again (LC...

A trick to file I-485 without your I-140 sponsoring employer

Re: Yee Man Chan It seems to me the revocation of I-140 can get to the I-485 processing officer quite quickly. The example I mentioned actually took very little time for the I-485 officer to generate an intent to deny. So I think the best bet is to stay with this employer past 180 days or...

A trick to file I-485 without your I-140 sponsoring employer

Re: Hi yee man chan I didn't have any paystubs from my new employer at the time, so I only sent the last paystubs from my sponsor. My new employer is a very reputable institution. I guess that may explain why I got approved without further RFE.

A trick to file I-485 without your I-140 sponsoring employer

Re: What if .. She may be in trouble because if the I-140 is revoked before 180 days, no one knows what will happen to her GC process. There is a possibility for denial but since I never heard a similar case. She should try to talk to the client to make sure they don't revoke. There is no...

A trick to file I-485 without your I-140 sponsoring employer

My RFE is for 3 things: 1) 5 recent pay stubs 2) W-2s from two recent years 3) Financial proof from my sponsor that they can pay my wage However, I responded with the following since I just joined my new employer: 1) last 5 paystubs from my sponsor 2) employment letter from my new...

Hey gpw Thanks for your response. Did you attach your sponsoring company's employment letter when you filed I-485? If you did, all you need to do is just give INS employment letter from your new employer. That's what I did to respond to my RFE and I got approved based on AC21...
