Another way to understand this is, a concurrent case will be tracked based on 140 RD, however this date will be compared to noncocurrent case 140 RD when put in the queue. Many "nonconcurrent" case has pretty much the same RD date for 140 and 485. Thus, this would prevent new case adjusted...

Did you ask about the separate track for concurrent filing, what staff/officers on that track are doing since there is no concurrent filing back in 2001.
So someone please explain what and when happens next? What else can USCIS do further delay the court decision? After the court decision, in case in favor of us, can CIS appeal?
(Almost?) every one with 140 pending filed under concurrent filing, be definition, which requires adj of 485 at the same time of 140. So I think they are in the same class of 485 applicants.
I don't think "refiling" will become reality. It will be absurd if we have to withdraw. Besides, I am on EAD, if I withdraw I loose status immediately. I am sure if we all refile as "new", the concurrently filing will take forever again.

agree. congressman or senator are all good candidates. I wrote to Dick Gephart twice, it was canned answer. But my date wasn't even close to "official" NSC date then. I will write to senator Bond soon if I don;t hear anything about second FP.
The question asked at the bottom of the doc is of concerns for many of us, if 140 approved, how would one's case treated? The new memo of concurrent filing apprently does not apply.

If I remember right, the FP only start around either 12 or 1pm. So get there a little bit early, and grab a ticket asap. The queue wasn't long. But it is a good idea to call them to find out if you have the number.
That is right, as I said in the another thread, we need make informed decision. Anyone like to hear input from Rajiv, PM Edision to get phone number for tomorrow phone conference.
Maybe I am a little emotional, becuase at this point I donnot think USCIS will "send" memo to explain...
