Eb1 Ea 140 It is for EB1 EA I-140. The Approval and RFE was from TSC.

Hi Folks, Many of you have noticed that USCIS sends an approval email for EB1 EA and later send an RFE. Can this be a case to sue for giving first Approval and later RFE which is in my case. Any comments/suggestions?

Apply at diff centers I applied twice. 1. First at NSC which was denied 2. Next at TSC which was denied too but I appealed , still pending in AAO office Bottom line is the next time you apply, you should mention your previous 140 filings.

Can the advertisements be placed while the prevailing wages are determined or you can place an AD only once you recieve the prevailing wage from SWA? The reason is in nur07 case, even if the wage changes then the advertisement can hold good

In addition, my lawyer told me that the prevailing wages takes 2 weeks from CA

Hi sjsd, In the appeal, you have to substantiate with new evidence. I was told that if you file appeal 1. service center can deny it if no new evidence 2. If new evidence, chances to end up in AAO office are more I dont know how are the success rates of appeals
