The only thing I can contribute here is my experience:
1. After getting my approval and stamping (spouse still pending), I moved (company transferred, I am still working with my GC sponsoring company .. I dont know why but ... ). I updated my address. My address did not get updated because I...
I was in a similar situation some time back. After you move (and if you have not received your card), you need to call VSC and talk to the call center representative. Explain your situation and she will transfer you to VSC for address change on your stamping. You will then get the card at the...
I saw that and the reason is that they have said that they will not be adjudicating those 485s that are not within Priority Dates and they take those numbers out of the picture. This is just a numbers game man ...
Even if you do not get your labor approved, you can get one year extensions on your H1B (based on pending labor application for more then 365 days prior to H1B expiring) until you get your GC. Hope this can help you somewhat .....
Just call them and explain the situation. They will send it back in a day. Happened with my wife as we had changed the address and had also updated the address, but USCIS being USCIS did not change it. So had to call them again and change and we got the EAD in a week.
Its not compulsory legally. It does not matter if the card says valid for work or not because their database is updated. The only reason why you should get it corrected though is because when you apply for loans, if you may have to show your card, it is better that it does not have any...
In my case even my lawyer has not received the 140 approval. Infact the current status of my 140 is:
Current Status:
On December 6, 2004, this case was reopened on a BCIS motion, and the case is now in process. It is taking between 90 and 485 days for us to process this kind of case. We...
You are not the only one. My spouse is pending too. I got approved end of Dec. last year. Infact there is a thread also for tracking such cases.
Also you should call VSC as some poster has suggested, it may not help all that much though. But once you talk to an officer you atleast know that...
Not correct. Even though they do not send a separate notice to deny EAD and AP, since these are dependent applications they are not valid if the primary basis (i.e. 485) is not valid.
Some lawyers have an interpretation that until the 485 is denied by the AAO, it is not considered completely...
For me they did not provide 3 pages. Hmmm ... so it could be the approval notice that they did not provide to me and since my case was denied first, I am guessing there are some pages that have notes exchanged between the adjudicator and another officer who would have reviewed my case that they...
I am not sure if you can use your EAD. Technically your 485 is denied and all related applications are denied, until they are reopened. So you should not work on EAD. If you have a valid H1 (or any other work visa), then you can continue using that. It is recommended that you do not work on EAD...
NO. My lawyer has opened a AILA Inquiry on this. I got an email from her this morning and I quote her:
"It is good to know that it was approved. You may never get the actual approval notice."
