Oh he just replied to my email and confirmed what you said about H1 extensions. Now he says in my case, there is no need for H1. He didn't know my priority date was current.
The whole conversation with him started with an email he sent out to me saying that when I cross the border during...
Yes I passed all the PERM requirements (which took 7 months). They just filed the PERM and I am EB2.
His email says some time in the future we will eventually convert you to H1.
Thanks nelsona for the reply and the link.
Now I don't trust the lawyer and am concerned he would screw me up. The PERM has been filed on 12/19/14 and they say my assigned priority date is also 12/19/14. Is this correct?
Maybe he is assuming my priority date isn't current and they can't do...
I know this is a TN forum but I'd like to share this and see if other Canadians have had a similar experience. I was on H-1B for 6 years for my former employer. Then had to switch back to TN. Now I have joined a new company that wants to sponsor me for GC. Currently I am on TN. However their...
lisanaderson you are so wrong! There is a directive from the gov for CBP officers not to reject entry on TN if I-140 is pending or approved. It is safe to go from any category to GC. How the heck do you think all these tourists on B get a GC after they marry a US citizen?!!! You must be a lawyer...
The TN-GC path is explained well in CuriousGeorge's post and explained in details in this forum numerous times. Just search the forum. The only downfall is you cannot travel outside the US from the time they file I-485 till you get EAD and AP (4 months roughly). So you should have enough on your...
No. H1B is not immigrant intent.
This is what I told my former employer's lawyer: so are you telling me if I got married to a US citizen while on TN or B1 or B2, I couldn't get a GC because TN is a non-immigrant status?!! What about all these Europeans who come here as a tourist and then get...
I don't understand your question. H1B is a dual intent visa. Meaning applying for it and/or getting it won't hurt at all and you can apply for all other statuses in the future including TN.
What is the reasoning your employer is giving you for not going down the TN -> GC path?
No. Have to quit my day job due to conflict of interest. Also I am already in the US on TN. I've been on it for so many years. I ceased to be a resident of Canada for tax purposes. How would that affect this and what do you suggest? I am assuming you meant I'd be self-employed in Canada and...
My friend is starting a consulting firm and wants to hire me as a contractor. He said he would pay me in 1099 form and he is ok with writing a letter for my TN.
I appreciate any advice on this 1099 thing and what I should be cautious about. Also, how should he put the 1099 thing in the TN...
As a matter of fact, one time the CBP officer asked me why I wasn't eagor about GC and finding an employer who'd sponsor me. I replied that I didn't want to retire in the US anyway and had no long term plans of living here.
Maybe his/her employer doesn't wants to sponsor for GC. I've been with the same employer for 9 years on TN-H1-TN and they don't want to sponsor. Pretty good job too. I'm starting to think the same way that I don't want to retire here in the US with all its problems :)
The person said he/she is not interested in GC! Why would you even go to the extent of talking about "draft"?! Stay on the subject please. Also, on a PR status you are required to live in the US for 6 months of the year.
I've heard from our company's division where they handle the hiring of contractors that recently fedral laws have changed and they are no longer allowed to hire contractors on TN and the contractors must be perm residents or US citizens even if they're hired thru a third party consulting firm...
Engineer. I've been with this employer for over 7 years. They had already got me H1-B before and I have used up my 6 years and had to switch back to TN.
