From what I seen and head, once you file your case, chances are slim to none to get another visa after you current visa expires.
The office at port of entry can also deny you entry if they could trace the case (even though it was withdrawn).
When you file the case, you intent to stay here and...
I think the ban is 10 years. So, before you leave consult an experienced immigration attorney. Also, I see that you'r from India and if your case was closed administratively or flagged as fraudulent then the situation is worse than you can imagine.
From what I heard and read, the process is much faster if you parents are citizens. If they just have GC and you are out of status and over 21 years old then get ready to wait a long time.
Its too early to be impatient.
Mine is pending since last 22 months and no decision.
So, forget about it, apply for EAD, find a job and pray before you go to bed.
I complete my two year anniversary and still nothing. I sent a mail inquiry like 3 months back but never got a response.
Looks like they stopped caring about inquiries.
I doubt you will get an answer. Relax and wait. Nothing you can do right now as they say the universe unfolds as it should. My case has been pending for 21 months now after interview.
It was last year. Don't worry, you will get it asap once you submit the documents they are requesting.
Getting an RFE means, you case is on top and being processed which is better than being stuck on initial review.
@Trinitymgn
I know from my experience, its just the opposite.
If you don't receive your denial within 5-6 months, chances are high you will be approved.
I don't think it is referred to IJ. The way my case is pending some checks, it could be the case with you as well.
But anyway, its been less than 2 months, so relax and hope that you don't have to be in my shoe.
After how long did you got your interview date?
You cannot track your status in uscis website unless you are approved.
So, the only way to check your case status would be either mailing them or calling their hot line. They never replied to my email but they do reply mails but in ages.
How long have you been pending?
I went for the interview...
I did like 4 times.
I always used to get that automated response with this check box checked 'Your case is pending....'.
I talked to a lawyer and he told me that all I can do is wait.
My interview went well and I was also in status when I applied.
I sent a new inquiry like 4 weeks ago but...
Last time when I got my EAD, it took 6+ months because of some stupid mistake. If your EAD is taking longer or exceeds 90 days, then chances are that you will receive a RFE soon asking you correct something.
When you mailed your documents, you should have a tracking number which confirms your application was delivered to them.
Get that information and verify with them so that they can track where the application is.
In the worst case scenario, the USPS might have delivered it to a wrong po box.
