I guess you\'re ok
Looks like your FP were sent by FBI, received by INS but still waiting in the first system, without being connected with your I-485 application (stored in the second system).
Some IIO can\'t (or don\'t want to) look in the first system and they just tell you that they are...
Yes henrysh, let us analyze this, I always like to analyze :)))
Some of Mar people still don\'t have FP.
You say that instead of waiting for those FP to be cleared the INS officers must approve the cases with FP already cleared.
I say that INS doesn\'t have to wait for FP to be cleared...
Jony Lever, what you regard as a thanksgiving gift will be injustice for about 50% of march people w
Issuing approvals for ND > Apr 10 while about 50% of ND March are still pending doesn\'t prove that INS is moving faster, it will only prove that INS is moving more chaotically...
PP stamping quite similar with other experiences on Ciba\'s site
Reached INS San Francisco on Friday 11:10am.
Entered through Sansome street, nobody waiting at this entrance (I have no idea about Washington St. entrance, I haven\'t even looked at it)
Showed the approval notice to the guard...
history before I-485
LC filled Aug-Sept 99, approved around Mar 2000, I-140 filled within weeks after LC approval, approved Oct 2000, lost a few months like an idiot (at that time I considered that there\'s plenty of time for GC) so I supplied all the required papers to attorney only on early...
EB3, PD always current
RD 02/21 (however the AVM always said "we received you application on March 16, it wil take 975 to 999 days, ...)
ND 03/19, WAC 01-132-XXXXX
FP notice received on 08/09, scheduled on 10/25 in San Francisco
FP done on 08/12 in San Jose
11/14 around 9:30PM the AVM...
Vine, your PD on that site is after ND!?!
Also only 2 out of 10 mentioned their PD. Folks, pls put the PD! There are many discussions about this, but still the most likely reason for employment RFE is old PD, so PD is a very important piece of info!
Thx

About 25% percent of people with ND between Jan-Apr 2001 have current PDs, many are already approved and I don\'t know a single case of them receiving employment RFE.
So, my opinion is that recent PD means no RFE, old PD may or may not trigger RFE depending on the mood of the INS...

my lawyer told me that if you have dependents then copy of the tax return is also required.
It\'s probably a good idea to put it there anyway.

Best case: approval after two weeks
Worst case: on Ciba\'s site you\'ll find people with ND March, FP April, still waiting for aproval
Horror case: there are people waiting since 1999, with FP in 1999 sau 2000

Well, at least there\'s nothing wrong on your side so you\'ll be able to correct it and get the GC. But it will take additional time :(((.
Maybe you can find a way to ask INS to process this faster than normal, since obviously is their fault.
Good luck and keep us updated.

The sad part is that even if you would have called IIO to check if they received your RFE response, this wouldn\'t made any difference because the IIO would just look in the system, find your RFE response and say "OK, we got it", but still the officer processing your case...
Doesn\'t look too bad
a) as far as i know there\'s no need to start GC for the same job as H1
b) if somebody messed up the employment letter, this can be corrected.
Good luck and let us know when you get the paper.
