Step 1: person files Eb1-OR concurrent with I-485 and both get denied. I-485 gets denied due to denial of I-140.
Step 2 : After 3 months, person also files NIW (non concurrent). NIW gets accepted.
On NIW approval, it possible for a person to reopen that old I-485.
If yes, how is it time...

It is recommended to get two affidavits (preferablly uncles/Aunties) along with what you have!! Yes, my brother got such as back up and submitted along with his post dated (which is also not acceptabel sometimes) birth certificate.

I agree June 2004 is early ..... from NSC point of view .........but VSC is screening JAN 2005 now as compared to JUNE 2003 for NSC. I Would say we shd write about it. Unfortunately I have no idea how to go for it.

If they are clearly written for EA don't use them.
But If they just mention permanent residency it will be wise to use if they mention about national interest, Labor (some of them even if not mentioning its alright) and your exceptional ability.

DOn't bother about the dates and other people's approval.
You have just started long journey of patient wait.
Don't worry about FP it will come. At least till that point and EAD NSC is quite promt.

I beleive for NSC this time frame is too early especially for EB1 and NIW
However, try at EB3 they are getting approval from NSC in this time frame.

Today is the day for EB2 from NSC.
I can see several cases approved for EB2 betwen Nov 2003 to March 2004.

Those who have filed november 2003 should expect decision soon as it appears NSC is going thru them now............based on search in some other forums on net and found that most of the october 2003 cases were approved for EB1 and EB2 in JAN 2005.

I applied for EB1-OR at NSC concureently on oct 2004
got FP done a month after
got EAD but not using it as i am in first year of H1
I guess i have to wait long!
