I am switching from industry (research engineer) to academia (assistant professor). I am trying to use AC21, but was told it may have some problems since the job title and duty is "different". But I can always argue both jobs in industry and academia need to the same or similar skills.
I am...
I got I-140 through EB-1(b) outstanding researcher sponsored by my first employer. After I-485 filed for two years, I left this company for the 2nd one. I wonder once my first I-485 is denied, what should I do? Can I file another I-140 sponsored by the second employer?
I got I-140 using EB-1(b) outstanding researcher sponsored by a company.
and my I-485 pending for two years and I am using EAD. Now I want to go back to academia and take a position of assistant professor. My question is: Can I use AC21 (my current title is "research engineer")? The title is...
Leto,
I think you have pretty strong case. Go ahead to file EB-1(b) Outstanding Researcher. I had similar background three years ago and obtained I-140 approval through company sponsored EB-1(b)
Good luck
Thank you, ginnu.
One thing I need to clarify: My I-140 is based on EB-1(b), outstanding researcher/professor, which is still company-sponsored, not EB-1(a) (extraordinary ability). So you previous statement still applies?
I would say I am really troubled by this transition. I hope you can...
Thank you, ginnu. You've been so helpful.

My best regards,

I am working in an industry company and now will switch to assistant professor at a university (jurisdicion will change from Texas to Nebraska). I am working under EAD (I485 notification date July 2002). I have three questions:
1 When I switch the job...

Chi-Square,
I would like to check with you to see how you apply for H1-B for backup. Remember I have the same situation. Today I called a lawyer to have a paid consultation. He told me I could not go back with H1-B anymore (I used H1B from 01/01/2001 - 01/01/2004) as I am in...
Re:
I called a lawyer (did not pay) and was told he would like to look at my case first and then if AC21 is applicable, he might want me to file in advance. Also he said I should transfer my case from Texas to Nebraska (as my new job under Nebraska jurisdiction)

Chi-Square,
It seems you did not work for the company that helped you file I-140 (and I-485) for more than 180 days, is that right?
If so, you might lose your I-485. You might need to try a new H1-B
My case is I have been working for the company for nearly two years...
