    citizship application and address change

I suggest you go ahead and make the corrections on your ID. The only possible problem I could think of is whether your new ID will raise questions regarding the district residency requirement for which you should be prepared to establish using your lease/mortgage payments, utility bills, etc.

    Simple trespass: Infraction

The N-400 form asks you if you have ever been cited. Your ticket for trespass probably counts as a citation. A citation is a type of summons to appear in court on a certain date. Check your ticket and see if you were required to do so (or required to pay for the ticket in lieu of a court...

Weird Situation : Six Months after Fingerprint But No Reply !!!

While you are in the process of sorting this out, you need to notify USCIS of your address change. Filing an AR-11 is not sufficient if you have a pending application. If you haven't already done so, you also need to call USCIS at 1-800-375-5283 and let them know you have a pending application...

Soon to apply for Citizenship with long absences from the US

I didn't read the case as narrowly. In both cases, aside from the regular returns to the US, extended family is present, mail (credit card, bank), not working abroad, filing of taxes. A case doesn't need to be on all four corners similar for it to be useful. And yes, I have cautioned OP about...

Soon to apply for Citizenship with long absences from the US

I have read the case and I (and the OP) am aware of that quote. Are you ruling out the chance that the IO would not weigh his studying abroad as a factor against the OP? The case is useful to establish that the focus is on ties to the U.S. and not simply on intent, as cafeconleche quickly discerned.

Soon to apply for Citizenship with long absences from the US

I don't think there's any harm in printing it out and bringing it to the interview. There might be a point in the interview that you may feel that you need to bring it to the IO's attention but it will be hard to tell if your IO will be responsive to legal arguments, choosing instead to focus on...

Soon to apply for Citizenship with long absences from the US

cafeconleche, There's a case from Massachusetts, Yu Ping Li v. Chertoff, about a U.S. resident who studied in Canada whose absences reached 6 months but less than 1 year. You might want to check it out for the reasoning and should at least be persuasive authority. I don't believe that was...

    Confused about Physical Presence requirements

Perhaps I should have been more precise in my use of certain terms in my earlier posts. I use the terms "rule", "rulemaking", and "notice and comment" as defined by the Administrative Procedures Act or APA which governs most of the rulemaking procedures by federal administrative agencies...

    Confused about Physical Presence requirements

It's all cool. I wouldn't be against such a rule. It's only fair to the majority who have complied and know that they truly want to live in the U.S. I just wish that before the $675 goes to the USCIS coiffer, applicants especially self-filers would be well advised of the consequences of their...

    Confused about Physical Presence requirements

I posed a question of law and a search of this forum might not yield any hits and not sure it would be helpful in this discussion. I think RealCanadian offered the most responsive answer when he/she touched on the subject of intent, although I differ in his opinion and think that imposing an...

Do i qualify for USA citizenship through parent?

that's good to hear. when you go to your passport agency, you need to establish that by providing a copy of the custody order, with a corresponding translation if necessary. you also need to show proof of your father's US citizenship. as others have pointed out, and as you have discovered, the...

Do i qualify for USA citizenship through parent?

That's what I'd like to find out - the OP did say his father had custody but I don't know if it's legal or physical custody. I think the Dominican Republic's laws on legitimation has been liberalized in the 90's and, at least from what I've read, children born out of wedlock have the same rights...

    Confused about Physical Presence requirements

All I'm asking, and as the OP is trying to find out, under what authority would the USCIS deny naturalization based solely on back-to-back trips under 6 months? The statute, INA 316 and the regulations are clear about trips between 6 months and 1 year and that the burden of proving no break in...

    Confused about Physical Presence requirements

A prominent NYC immigration attorney has an article on http://bit.ly/bTKVuC relating to naturalization. In the article, he notes the following with respect to continuity of residence: "Some examiners improperly club two back to back lengthy trips out of the U.S. of less than 180 days." I'm...

    Confused about Physical Presence requirements

The rules for absences between 6 months and 1 year and absences of over 1 year are more or less clear, of course subject to interpretation in certain situations. There are no set rules that I know of that cover back to back trips under 6 months but we all know that in reality, immigration...
