    I-140 From my understanding, some of the service centers are still seeing to it that 140 has to be approved to use AC-21. So basically depends on what center you are filed with (Till a few days back, for sure Texas center had mentioned taht they need approved 140 to consider AC21.....not sure...

    No biometrics – more than 60 days have passed

    Same notice I got the exact same notice. But mine is only 8 days old (Approved Jul 18th)so no idea what will happen yet. Did you go to local USCIS office and get a stamp in your passport?

    Visa denied; Filing a motion to reopen.

    Get senator involved I feel you should get your local senator involved. My wife's visa case was in a big and very complicated mess. Senators helped greatly to get it resolved. (This is just my opinion. Consulting an immigration lawyer should be the best thing to do)

    Not exactly true Clarification: all EB3 applicants are stuck. Nothing to do with being Indian Citizen. Being Indian citizen would affect you, only if your priority date is not before the retrogression date. EB3 will be available back in October 2005. Till then all EB3 applications will be stuck.
