Tracking for EB2-NIW with PD Sep 2005 Only

abhuda, First, let me say that I am sorry to see you and many others who have NIW approved for years and yet no GC in hand - you folks should have had it long time ago. However, citing data from trackitt.com may not help too much here, in my humble opinion - the USCIS can simply say either...

What pro-active action can i take?

The latest processing date of I-485 at TSC is 06/21/07, so the service rep was right that she could not open another SR for you. Yes, the processing date rolled back this time, and it is not the first time that happened and very likely it is not the last time either. Also, whoever you talked to...

New American Innovators Act (Introduced in House)

If I understand it correctly (I have yet to find the complete text of the bill, though - cannot find it from the Congress's website), it will relieve folks from retrogressed countries, but that is it - it does NOT create new visa category like the one introduced in last year's Immigration Reform...

    EB1-OR thro a University

Sorry to hear that, dnastar. I wish you a better luck this time around. Yes, there are denials for EB1-OR. I personally know a junior faculty (on tenure track) her EB1-OR was denied when she was in a top medical school (a very famous one in Baltimore, in case you wonder :)). This whole...

    My EB2-NIW RFE Letter!

Congrats, JerIst! As I said repeatedly, they really have no reason not to let you get through after the RFE. Good luck with the I-485!

    Please evaluate and give suggestions

NIW_help, Your credentials are pretty good for both EB1-OR and NIW - you got some independent reco letters overseas (which is critical to EB1-OR, as it specifically requires international recognition) and impressive citation numbers (which help a lot in dealing with NIW). Just try to present...

    December 2006 NIW approval

Good to see you submit the reply to the RFE, JerIst. I cannot think any reasons why you won't get through after the RFE - you got everything! Keep finger crossed and let us know as soon as you get the good news.

    NIW 140 RFE from NSC

As jk0274 pointed out, the absence of citation index in the original petition may be the key reason of the RFE, since it is often the most "convenient" objective evidence for the adjudicators, if the petitioner is a researcher. The other one is your degree: did you have a M.S. or the equivalent...

    At last, it is done!

Thank you all, JerIst, EB1today, jk0274, and lakksh. The new rules regarding to namecheck is definitely good news to virtually everyone, except the possibility of triggering further retrogression in some categories/countries. JerIst, have you sent out your reply to the RFE? My best...

    At last, it is done!

Dear all, Finally, after almost two years of struggling, I got the NIW I-140 approval notice email today :D. My first try of NIW was denied at NSC after 14 months, and I re-filed to the TSC during the July VB fiasco last year. Two weeks before last Christmas, I got a very non-specific RFE...

    RFE Response time?

It depends. According to the Interoffice Memorandum from the USCIS (issued 06/01/2007), the "standard timeframe" for an RFE response is as following: To submit initial evidence that the form requires the applicant or petitioner to file.....30 calendar days. To submit evidence that Form...

    NIW approved...but so what!!!

Congratulations! I know your publications are amazing and you surely deserve the approval. Good luck with the EB-1 petition. :)

    Question about NIW RFE

Since you have EB1A I-140 approval already, you can happily withdraw the NIW. It's probably not too good an idea to just ignore the NIW RFE without reply or withdraw, since that will lead to denial of the NIW eventually, and you will have a record of visa application denial - probably it does...

    My EB2-NIW RFE Letter!

Hi jk0274, Do you mean that you/your lawyer did not present your case prong by prong (its intrinsic merit, it is national in scope, and NI will be adversely affected if a LC were required) for NIW? That can be a little confusing to the IO.... On the other hand, as JerIst pointed out, these...
