I like to start this thread to Track appeals/MTR Status, Please looking for cooperation who filed Appeals.

My appeal details:
Appealed on I140
Date: 06/22/2004
RD/ND: ?

BCIS,

Do you have any statistics on %rate of approval chances(MTR/appeals). Thing is many I-140's from the same company were approved. one other was rejected with educational equivalancy. Does this depends on company financial status during the labor applied date?

No..

Is yours 140 Rejected as per previous posting on Financial issue ?

I believe it's NO,At present only
 
dont know the receipt data

my attorney sent the appeal out on 17th of june. She might have received the receipt date. The same was not updated on USCIS site. Ofcourse it is not even showing me about I-140 denial (online)

my I-140 was denied stating my company financial status was not good during 2002. My company showed up atleast 300K profits for 2003 and we attached all my paystubs which is almost matching the salary specified in the labor. Nobody knows why it was rejected bcoz other guys from the same company got approvals during the same period
 
I140 status will not change with Appeal.

You will get another LIN# for the appeal/MTR

not received LIN for appeal

BCIS,

I checked with my lawyer about the receipt date for MTR. As per them they never received a new LIN number

once U applied 290B then Service center issue a receipt notice.

Hi,

I-140/485 ND: 08/26/04

My I-140 denied (Education equivalency)

MTR applied: June 14th, 2004

MTR before commissioner denied on July6th, 2004

Appeal to AAU : Attorney preparing to send to AAU.

Appealed.........7/14/2004 (With new Ed. Evaluation/Supporting doc. to pay)

Usually with in 30 days allowed for appeal.

this mean it went to DC office
 
Bur what puzzles me is that my lawyer mailed the application directly to DC office as appeal was made after 33 days from the date as per the instructions on the form. Now it says it was forwarded to AAO..Confused

Ed. Background: Bsc/Msc in Botany with lots of computer courses

This time I140-Application status changed to,
On July 28, 2004, we received your response to our request for evidence or information. It is taking between 150 and 180 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.

Any Idea, What's going on????

Normally for Appeal, it goes to AAU, Washington???

I did experience similar situation when I applied for my L1A extension. One fine day my case was not available in USCIS case status system. The next day when I checked it showed my case with approval message.

It happene with one of my friend also, his case was H1B extension.

Hope your case also gets approved.
