Hi,
I am applied for GC for my spouse through CP in India, my wife came into the country and stayed with me for 2 months, she told me she would want to go back and meet her folks in india. After some time she has abondaned me. I have divorce proceedings going aginst her. I acted in good faith and got her GC but she has hurt me badly by abondaning the marriage. She has in her possession her GC and passport, affadavit of support i filed for her.
My question: is there any legal way by which i can pursue her GC as fraud by marriage?
Any input will be appreciated.
Thanks,
Joe

It is tough to have a employment-gc of dependent revoked after it has been granted to dependent. In the event you carry out legal proceedings you too might be considered complicit in the 'fraud'.
Even when you want to contest a dependent's gc before approval you have to have a divorce decree on hand and submit it to ins.
If you are a citizen then your case can have some credibility.
You should consult a lawyer.

485 Pending

I-485 is pending for me and my wife because of priority date not current. She is my dependent and we both are in USA. Is it possible for me to cancel/revoke her 485 application? Please advice.

so, he still has a question.
Answer: I-485 belongs to your wife and she was the one to file it. She is the only one that can revoke it short of USCIS denying it for some other valid reason.

With her as the dependent, a divorce would invalidate her I-485.

What are you trying to do? Punish her for divorcing you, or ensuring that you stay within immigration law?

If the first: go think long and hard and among other things think about ways in which she could potentially retaliate.

If the latter: just inform USCIS that you are no longer married (or are you still in the process of getting a divorce?) and leave it up to them how to deal with that.

Bringing on wife here as dependent and once if things doesn't work out they are thinking an option of how to remove her from the process of green card. This is the thing happening today with most of them.please change, give her some time and be on her own way
