May I ask for your help for the following quick question?
I’m a DV 2020 AOS immigrant. I’m going through the naturalization process and still waiting for the oath ceremony. I will be soon filing my taxes but I moved between states last year. While waiting for the oath ceremony, I don’t want to make a huge mistake on tax filing status, as I’m second guessing everything as an immigrant these days.
Particularly, I have a question about the “nonresident alien” on a tax return. I’ve always filed federal taxes as a resident (Form 1040) after getting my green card. However, due to moving between states, I’m filing state returns as nonresident / part-year resident (e.g., CA 540NR, IN IT-40PNR). My understanding is that, “Nonresident alien” refers to federal tax/immigration status, and “Nonresident” on state forms refers only to state residency, not immigration status. Is my understanding correct that filing state nonresident or part-year resident returns does NOT mean you are calling yourself a “nonresident alien” as an LPR?
